NIEMIETZ v. GERMANY
Allemagne (16 décembre 1992, série A no 251-B). - EGMR, 25.02.1993 - 10828/84
FUNKE v. FRANCE
Royaume-Uni, 30 mars 1989, § 51, série A no 152-A ; Niemietz, précité, §§ 29-33 ; Funke c. France, 25 février 1993, § 48, série A no 256-A ; Crémieux c. France, 25 février 1993, § 31, série A no 256-B ; et Miailhe c. France (no 1), 25 février 1993, § 28, série A no 256-C). - EGMR, 28.10.1999 - 28396/95

Liechtenstein [GC], no 28396/95, § 46, CEDH 1999-VII).

Royaume-Uni, no 35394/97, § 26, CEDH 2000-V). - EGMR, 30.03.1989 - 10461/83

In other cases, the Court relies on the submissions of the parties alone and, in so doing, suggests that it refrains from acting proprio motu (see, for instance, Turek v. Slovakia, no. 57986/00, § 99, ECHR 2006-II (extracts), Peev v. Bulgaria, no. 64209/01, § 62, 26 July 2007; Starokadomskiy v. Russia, no. 42239/02, § 83, 31 July 2008; Gubkin v. Firma durfte Mitarbeiter wegen privater Nachrichten kündigen
In a case in which the applicant's workspace at a prosecutor's office had been searched and some of his belongings had been seized (Peev v. Bulgaria, no. 64209/01, 26 July 2007), the Court held that the search amounted to an interference with the applicant's "private life"; the Court found that the applicant had a reasonable expectation of privacy with regard to the personal belongings that he kept in his office (ibid., § 39).1 This caselaw is still limited (see Copland v. the United Kingdom, no. 62617/00, ECHR 2007-I, and Peev v. Bulgaria, no. 64209/01, 26 July 2007).

BORISLAV TONCHEV v. BULGARIA
More generally, the existence or absence of prejudice has no bearing on the question of whether someone can claim to be a victim within the meaning of Article 34 (former Article 25) of the Convention; it is relevant only in the context of Article 41 (former Article 50) of the Convention (see, among other authorities, Marckx v. Belgium, 13 June 1979, § 27 in fine, Series A no. 31; Lüdi v. Switzerland, 15 June 1992, § 34, Series A no. 238; and Peev v. Bulgaria, no. 64209/01, § 55, 26 July 2007 ) and also, since June 2010, in assessing whether an applicant has suffered a significant disadvantage within the meaning of Article 35 § 3 (b) of the Convention, which was inserted by Article 12 of Protocol No. 14.

FRIEND AND OTHERS v. THE UNITED KINGDOM
However, in Peck and other cases where the Court has found an interference with the private life of an applicant whilst he or she was in a public space, it has always considered whether the applicant had a reasonable expectation of privacy at the time (see, as a recent authority with further references, Peev v. Bulgaria, no. 64209/01, §§ 37-39, ECHR 2007-... (extracts)). - Generalanwalt beim EuGH, 29.04.2021 - C-852/19

DIMITROV AND HAMANOV v. BULGARIA
Therefore, it cannot be regarded as an avenue whereby persons charged with criminal offences can vindicate, as such, their right to a hearing within a reasonable time (see Ommer v. 19 In der Vorlageentscheidung wird nach der Wiedergabe des innerstaatlichen Rechts darauf hingewiesen, dass sich die Republik Bulgarien nach dem Erlass der Urteile des EGMR vom 26. - EGMR, 07.11.2017 - 21200/05
AKHLYUSTIN v. RUSSIA
The Court has also found that a search of a prosecutor's office amounted to an interference with his "private life" (see Peev v. Bulgaria, no. 64209/01, §§ 37-40, 26 July 2007) and that covert filming of a person on police premises was also an interference with private life (see Perry v. the United Kingdom, no. 63737/00, §§ 36-43, ECHR 2003-IX (extracts)). - EGMR, 03.06.2008 - 9676/05
Bulgarien , Individualbeschwerde Nr. 64209/01, Randnrn. 37-40, EGMR 2007-...). - EGMR, 16.02.2021 - 69762/12
BUDAK v. TURKEY
According to the Court's settled case-law, the phrase "in accordance with the law" requires, at a minimum, compliance with domestic law (see Peev v. Bulgaria, no. 64209/01, § 43, 26 July 2007). - EGMR - 27313/23 (anhängig)
