TESTA v. CROATIA
By contrast, in some other cases no violation of Article 3 was found, as the restricted space in the sleeping facilities was compensated for by the freedom of movement enjoyed by the detainees during the day time (see Valasinas, cited above, §§ 103, 107, and Nurmagomedov v. Russia (dec.), no. 30138/02, 16 September 2004). - EGMR, 08.01.2013 - 56027/10
[ENG]
In a number of cases the Court has found that the freedom of movement allowed to inmates in a colony and unobstructed access to natural light and air have served as sufficient compensation for the scarce allocation of space per convict (see, among others, Valasinas v. Lithuania, no. 44558/98, §§ 103 and 107, 24 July 2001; Nurmagomedov v. Russia (dec.), no. 30138/02, 16 September 2004; Shkurenko v. Russia (dec.), no. 15010/04, 10 September 2009; and Orlov, cited above, § 77). - EGMR, 25.09.2008 - 30997/02
POLUFAKIN AND CHERNYSHEV v. RUSSIA
As regards the complaints about the temporary detention centre and remand prison of Cheboksary, the first applicant's detention in these facilities ended on 18 December 2000 and 24 January 2002 respectively, which is more than six months prior to the date of introduction of the complaint (see, for example, Nurmagomedov v. Russia (dec.), no. 30138/02, 16 September 2004).m. of personal space and did not allege that he had no individual bed (see Nurmagomedov v. Russia (dec.), no. 30138/02, 16 September 2004).
- EGMR, 13.07.2006 - 26853/04
POPOV v. RUSSIA
By contrast, in some other cases no violation of Article 3 was found, as the restricted space in the sleeping facilities was compensated for by the freedom of movement enjoyed by the detainees during the day-time (see Valasinas, cited above, §§ 103, 107, and Nurmagomedov v. Russia (dec.), no. 30138/02, 16 September 2004). - EGMR, 08.10.2024 - 48047/15
JESUS PINHAL c. PORTUGAL et 2 autres affaires
Se référant aux affaires A.R. c. Italie (no 13960/88, 12 octobre 1992), Bravo Belo c. Portugal ((déc.), no 57026/11, 21 juin 2016), Previti c. Italie ((déc.), no 1845/08, § 80, 12 février 2013) et Nourmagomedov c. - EGMR, 12.11.2015 - 32036/10
BUTKO v. RUSSIA
The Government pointed out that, in contrast to cases concerning detention conditions in remand prisons, the applicant had enjoyed a greater freedom of movement during the daytime and had had unobstructed access to natural light and air (here they referred to Orlov v. Russia, no. 29652/04, § 77, 21 June 2011; Pitalev v. Russia, no. 34393/03, § 38, 30 July 2009; Solovyev v. Russia (dec.), no. 76114/01, 27 September 2007; and Nurmagomedov v. Russia (dec.), no. 30138/02, 16 September 2004). - EGMR, 16.09.2014 - 49169/09
STELLA ET AUTRES c. ITALIE
En revanche, la Cour n'a pas conclu à la violation de l'article 3 dans des cas où un espace réduit dans les cellules était compensé par une grande liberté de circulation en dehors des cellules pendant la journée (Valašinas c. Lituanie, no 44558/98, §§ 103, 107, CEDH 2001-VIII, Nurmagomedov c. Russie, no 30138/02, 7 juin 2007, et Grzywaczewski c. Pologne, no 18364/06, §§ 92-93, 31 mai 2012). - EGMR, 17.01.2012 - 43710/07
FETISOV AND OTHERS v. RUSSIA
Thus, temporary detention wings located inside police stations are designed for short-term custody only and often lack the amenities indispensable for prolonged detention, such as a toilet, sink, or exercise yard (see for example Shchebet v. Russia, no. 16074/07, § 89, 12 June 2008), whereas in correctional colonies - in contrast to remand prisons - the restricted space in the dormitories is compensated for by the freedom of movement enjoyed by the detainees during the day-time (see Nurmagomedov v. Russia (dec.), no. 30138/02, 16 September 2004). - EGMR, 02.06.2005 - 66460/01
NOVOSELOV v. RUSSIA
By contrast, in some other cases no violation of Article 3 was found, as the restricted space in the sleeping facilities was compensated by the freedom of movement enjoyed by the detainees during the day-time (Valašinas, cited above, §§ 103 and 107; Nurmagomedov v. Russia (dec.), no. 30138/02, 16 September 2004). - EGMR, 16.06.2005 - 62208/00
LABZOV v. RUSSIA
By contrast, in some other cases no violation of Article 3 was found, as the restricted space in the sleeping facilities was compensated by the freedom of movement enjoyed by the detainees during the day-time (see Valašinas, cited above, §§ 103, 107; Nurmagomedov v. Russia (dec.), no. 30138/02, 16 September 2004). - EGMR, 24.06.2014 - 72710/11

As regards allocation of space, the Court concludes that the freedom of movement allowed and unobstructed access to natural light and air compensate for the relatively small dimensions of the applicant's room and the scarce space allocation per convict (cf. Valašinas v. Lithuania, cited above, §§ 103 and 107; see, by way of contrast, Kalashnikov v. Russia, no. 47095/99, § 97, ECHR 2002-VI). - EGMR, 24.07.2001 - 44558/98

However, it is incumbent on the State to ensure that a person is detained in conditions which are compatible with respect for his human dignity, that the manner and method of the execution of the measure do not subject him to distress or hardship of an intensity exceeding the unavoidable level of suffering inherent in detention and that, given the practical demands of imprisonment, his health and well-being are adequately secured (see Valašinas v. Lithuania, no. 44558/98, §§ 101-102, ECHR 2001-VIII). - EGMR, 10.07.2001 - 33394/96

(b) The Court further notes that ill-treatment must attain a minimum level of severity if it is to fall within the scope of Article 3 (see Price v. the United Kingdom, no. 33394/96, § 24, ECHR 2001-VII).
