    Auszug aus EGMR, 07.01.2014 - 3363/08
The Criminal Code (Krivicni zakonik, published in OG RS no. 85/05, amendments published in OG RS nos. 88/05, 107/05, 72/09 and 111/09).

    58/04, 85/05, 115/05, 49/07, 122/08, 20/09, 72/09 and 76/10).

Article 5 was somewhat changed with the entry into force of the amendments to the Code of Criminal Procedure published in OG RS 72/09.

Up until September 2009, which is when the amendments to the Code of Criminal Procedure published in OG RS 72/09 entered into force, Article 142 § 2 (5) provided that a person may be remanded in custody on reasonable suspicion of having committed a crime if the potential sentence is imprisonment of more than ten years and if this is justified due to the way in which the crime in question had been perpetrated or due to other particularly serious circumstances regarding the crime (ako je to opravdano zbog nacina izvrsenja ili drugih posebno teskih okolnosti krivicnog dela).

Even when, strictly speaking, no complaint has been made, an investigation must be started if there are sufficiently clear indications that ill-treatment has been used (see Stanimirovic v. Serbia, no. 26088/06, § 39, 18 October 2011).

The Court continued as follows: "Even when, strictly speaking, no complaint has been made, an investigation must be started if there are sufficiently clear indications that ill-treatment has been used (see Stanimirovic v. Serbia, no. 26088/06, § 39, 18 October 2011).

This is a duty of the public prosecutor who is better equipped in that respect (Stojnsek v. Slovenia, no. 1926/03, § 79, 23 June 2009; and Otasevic v. Serbia, no. 32198/07, § 25, 5 February 2013).

    JAKOVLJEVIC v. SERBIA

The relevant domestic case-law concerning the use of civil-law legal remedies in respect of private life-related issues is outlined in the case of Lakatoš and Others v. Serbia (no. 3363/08, §§ 43-44 and 51-52, 7 January 2014).

They relied on the Court's judgment in the case Lakatoš and Others v. Serbia (no. 3363/08, 7 January 2014).

  • EGMR, 15.10.2019 - 27929/10

PURIC v. SERBIA and 1 other application

The relevant domestic law is outlined in the case of Lakatoš and Others v. Serbia (no. 3363/08, § 38, 7 January 2014).

The Court notes that it has already found a violation of this provision in respect of Serbia in a similar situation (see Lakatoš and Others v. Serbia, no. 3363/08, §§ 91-98, 7 January 2014).

    MARINAKIS c. GRÈCE

ii) les recours généraux pour la protection des droits de la personnalité, habituellement le droit à la réputation (Babjak et autres c. Slovaquie, no 73693/01, 30 mars 2004 ; Lakatoš et autres c. Serbie, no 3363/08, §§ 108-113, 7 janvier 2014 ; et Januškevičienė, précité, § 68).

    HAÁSZ v. HUNGARY

I am aware of the line of cases according to which, if a criminal report or complaint has been filed with the police or the prosecutor, the victim should not be required to lodge a further criminal complaint with the competent court (see, for example, Balogh v. Hungary, no. 47940/99, §§ 31-32, 20 July 2004; Stojnšek v. Slovenia, no. 1926/03, § 79, 23 June 2009; Gubacsi v. Hungary, no. 44686/07, § 32, 28 June 2011; Borbála Kiss v. Hungary, no. 59214/11, § 26, 26 June 2012; Volk v. Slovenia, no. 62120/09, § 78, 13 December 2012; Otašević v. Serbia, no. 32198/07, § 25, 5 February 2013; Lakatoš and Others v. Serbia, no. 3363/08, § 80, 7 January 2014; and Milić and Nikezić v. Montenegro, nos.

    PETROVIC v. SERBIA

Until conviction, the accused must be presumed innocent, and the purpose of the provision under consideration is essentially to require the individual's provisional release once continued detention ceases to be reasonable (see also Lakatoš and Others v. Serbia, no. 3363/08, § 91, 7 January 2014).
  • EGMR, 26.01.2021 - 73313/17

    ZLICIC v. SERBIA

It therefore decides to join this objection to the merits of the applicant's complaint (see, mutatis mutandis, Lakatoš and Others v. Serbia, no. 3363/08, § 57, 7 January 2014, and Gjini v. Serbia, no. 1128/16, §§ 64-67, 15 January 2019).
  • EGMR, 02.06.2026 - 34695/22

    RATH v. THE CZECH REPUBLIC

Since in such circumstances criminal proceedings could neither put an end to the alleged violation of the applicant's presumption of innocence nor offer any meaningful redress, the Court concluded that only the civil-law remedy - if available in the relevant domestic system - could, on the basis of the criteria set out in the Court's case-law, provide adequate and sufficient redress and, therefore, must be exhausted (se Okropiridze, cited above, § 114, Lakatoš and Others v. Serbia, no. 3363/08, §§ 108-11, 7 January 2014; Januškevičienė v. Lithuania, no. 69717/14, § 59, 3 September 2019, with further references).
  • EGMR, 07.09.2023 - 43627/16

OKROPIRIDZE v. GEORGIA and 1 other application

In such circumstances, only the civil-law remedy could, on the basis of the criteria set out in the Court's case-law, provide adequate and sufficient redress (see Lakatoš and Others v. Serbia, no. 3363/08, §§ 108-11, 7 January 2014; Januškevičienė v. Lithuania, no. 69717/14, § 59, 3 September 2019, with further references).
  • EGMR, 14.04.2020 - 75229/10

    PETROVIC v. SERBIA

The request for the award to be paid into the bank account of the applicant's lawyer must therefore be rejected (compare and contrast with, for example, Hajnal v. Serbia, no. 36937/06, § 148, 19 June 2012, and Lakatoš and Others v. Serbia, no. 3363/08, § 118, 7 January 2014).
  • EGMR, 10.10.2023 - 31634/18

    RIMSÄ'VICS v. LATVIA and 1 other application

The Court notes that under this provision a complaint alleging a violation of the presumption of innocence by statements of those not involved in criminal proceedings can be submitted by the individual concerned in the course of the ongoing criminal proceedings (contrast Lakatoš and Others v. Serbia, no. 3363/08, § 113 in fine, 7 January 2014, and Orkopiridze, cited above, § 114).
