It has also found Article 6 § 2 to be applicable in respect of the public comments of police officers suggestive of an accused's guilt of charges even though the proceedings on those charges were subsequently discontinued (see the Allenet de Ribemont v. France judgment of 10 February 1995, Series A no. 308, pp. 15-17, §§ 32-37). - EGMR, 25.03.1983 - 8660/79

BYRN v. DENMARK
Auszug aus EGMR, 21.12.2000 - 34720/97
The Court recalls that an accused's acquittal, in general, precludes that person from claiming to be a victim of a violation of the procedural guarantees of Article 6 (see, for example, Byrn v. Denmark, application no. 13156/87, Commission decision of 1 July 1992, Decisions and Reports 73, p. 5).

In examining whether a procedure has extinguished the very essence of the privilege against self-incrimination, the Court will examine the nature and degree of the compulsion, the existence of any relevant safeguards in the procedures and the use to which any material so obtained is put (see e.g. Heaney and McGuinness v. Ireland , no. 34720/97, judgment of 21 December 2000, §§ 54-55, and J.B. v. Switzerland , no. 31827/96, judgment of 3 May 2001). - EGMR, 10.03.2009 - 4378/02

For this reason, the Court must first consider the nature and degree of compulsion used to obtain the evidence (see Heaney and McGuinness v. Ireland, no. 34720/97, §§ 54-55, ECHR 2000-XII; O'Halloran and Francis, cited above, § 55; and Bykov, cited above, § 92).The Court has stressed the importance of adhering to the Convention values in a similar context in respect of Article 6 (see Heaney and McGuinness v. Ireland, no. 34720/97, ECHR 2000"XII, where the Court found that the security and public-order concerns invoked by the respondent Government could not justify a provision which extinguished the very essence of the applicants' rights to silence and against self-incrimination; see also Salduz v. Turkey (GC), no. 36391/02, ECHR 2008, and El Haski v. Belgium, no. 649/08, 25 September 2012).

Irland , Individualbeschwerde Nr. 34720/97, Randnr. 57 - 58, ECHR 2000-XII; und Papon ./. Ireland, no. 34720/97, § 40, ECHR 2000-XII; J.B. v. Switzerland, no. 31827/96, § 64, ECHR 2001-III).

TULEYA v. POLAND
Thus, for example, a person arrested on suspicion of having committed a criminal offence (see, among other authorities, Heaney and McGuinness v. Ireland, no. 34720/97, § 42, ECHR 2000-XII, and Brusco v. France [GC], no. 25444/94, § 66, ECHR 1999-II, and Pedersen and Baadsgaard v. Denmark [GC], no. 49017/99, § 44, ECHR 2004-XI) can all be regarded as being "charged with a criminal offence" and claim the protection of Article 6 of the Convention. - EGMR, 04.10.2022 - 58342/15
DE LEGÉ v. THE NETHERLANDS
In cases where the privilege against self-incrimination is applicable (see Jalloh, cited above, §§ 110-13), the Court has held - noting that the right not to incriminate oneself is not absolute (see Heaney and McGuinness v. Ireland, no. 34720/97, § 47, ECHR 2000-XII; Weh, cited above, § 46, and O'Halloran and Francis, cited above, § 53) - that the degree of compulsion applied will be incompatible with Article 6 where it destroys the very essence of the privilege (see John Murray v. the United Kingdom, 8 February 1996, § 49, Reports 1996-I). - Generalanwalt beim EuGH, 11.07.2024 - C-767/22

O'REILLY v. IRELAND
Auszug aus EGMR, 21.09.1999 - 34720/97
The Court recalls that an applicant is required to make normal use of domestic remedies which are effective, sufficient and accessible (No. 24196/94, O'Reilly v. Ireland, Dec. 22.1.96, D.R. 84-B, at p. 81).In a legal system which provides constitutional protection for fundamental rights, it is incumbent on the aggrieved individual to test the extent of that protection and, in a common law system, to allow the domestic courts to develop those rights by way of interpretation (No. 24196/94, O'Reilly v. Ireland, loc. cit., at p. 82).
In addition, by the time the Supreme Court had rejected the applicants' constitutional action, more than five years had elapsed since their conviction under section 52 of the 1939 Act in June 1991 (no. 24196/94, O'Reilly v. Ireland, loc. cit., at p. 82).

FUNKE v. FRANCE
Auszug aus EGMR, 21.09.1999 - 34720/97
They distinguish the Funke v. France case (judgment of 25 February 1993, Series A no. 256-A), pointing out that Mr Funke was subjected to a continuing sanction as long as he refused to provide the requested information. - EGMR, 23.11.1993 - 14838/89
A. v. FRANCE
Auszug aus EGMR, 21.09.1999 - 34720/97
However, the essential facts constituting an offence under Article 52 of the 1939 Act, the request for and the refusal to provide information, were not in dispute in the domestic proceedings and it is recalled that an applicant, who has made use of a remedy which is apparently effective and sufficient, cannot be required to try others which are available but probably ineffective (No. 14838/89, Dec. - EKMR, 16.12.1981 - 8395/78
X. v. DENMARK
Auszug aus EGMR, 21.09.1999 - 34720/97
The Court notes the terms of section 29 of the Courts of Justice Act 1929 and recalls that an extraordinary remedy, the use of which depends on the discretionary power of a public authority, cannot be considered to be an effective remedy within the meaning of Article 35 § 1 of the Convention (No. 8395/78, Dec. 16.12.81, D.R. 27, p. 50).
