The latter provision has allowed complaints of this nature to be examined where the circumstances were not such as to engage Article 2, but clearly affected a person's family and private life under Article 8 (see LÏŒpez Ostra v. Spain, 9 December 1994, Series A no. 303-C and Guerra and Others, cited above).The Court has also held on many occasions that the State has a positive duty to take reasonable and appropriate measures to secure an applicant's rights under Article 8 of the Convention (see, among many other authorities, López Ostra, cited above, § 51, Series A no. 303-C; Powell and Rayner v. the United Kingdom, 21 February 1990, § 41, Series A no. 172; and, more recently, Di Sarno and Others v. Italy, no. 30765/08, § 96, 10 January 2012).

The Court further notes that it has previously recognised the standing of the victim's next-of-kin to submit an application where the victim had died or disappeared in circumstances which were alleged to engage the responsibility of the State giving rise to issues under Article 2 (see Çakıcı v. Turkey [GC], no. 23657/94, § 92, ECHR 1999-IV, and Bazorkina v.
