    KRYZEVICIUS v. LITHUANIA

    Auszug aus EGMR, 13.12.2018 - 66650/13
The case originated in eleven applications (nos. 66650/13, 24749/16, 43327/16, 62775/16, 68722/16, 76071/16, 8051/17, 8702/17, 12870/17, 21246/17 and 37696/17) against the Republic of Azerbaijan lodged with the Court under Article 34 of the Convention for the Protection of Human Rights and Fundamental Freedoms ("the Convention") by eleven Azerbaijani nationals ("the applicants"), on various dates (see Appendix).

43327/16, 62775/16, 8051/17, 8702/17 and 12870/17 lodged a further complaint, arguing that there had been a hindrance to the exercise of their right of individual application under Article 34 of the Convention, the relevant part of which reads as follows:.

43327/16, 62775/16, 8051/17, 8702/17 and 12870/17, and the material available to it, the Court finds that there is no sufficient factual basis for it to conclude that the authorities of the respondent State have interfered in any way with the applicants' exercise of their right of individual application in the proceedings before the Court in relation to the above-mentioned applications (compare Juhas Đurić v. Serbia, no. 48155/06, § 75, 7 June 2011, and Vasiliy Ivashchenko v. Ukraine, no. 760/03, § 115, 26 July 2012).

The applicants, except the applicant in application no. 62775/16, each claimed the following amounts for legal services incurred in the proceedings before the domestic courts and the Court: EUR 1, 006 in application no. 66650/13; EUR 3, 200 in application no. 24749/16; EUR 1, 600 in application no. 43327/16; EUR 500 in application no. 68722/16; EUR 3, 180 in application no. 76071/16; EUR 2, 442 in application no. 8051/17; EUR 2, 038 in application no. 8702/17; EUR 2, 023 in application no. 12870/17; EUR 2, 980 in application no. 21246/17; and EUR 2, 209 in application no. 37696/17.

76071/16 and 21246/17 further claimed EUR 370 and 295 respectively for translation costs.

    ANNAGI HAJIBEYLI v. AZERBAIJAN

    Auszug aus EGMR, 13.12.2018 - 66650/13
In this context, "any form of pressure" includes not only direct coercion and flagrant acts of intimidation, but also other improper indirect acts or communication designed to dissuade or discourage applicants from pursuing a Convention complaint or having a "chilling effect" on the exercise of the right of individual application by applicants and their representatives (see Annagi Hajibeyli v. Azerbaijan, no. 2204/11, § 66, 22 October 2015, and Hilal Mammadov v. Azerbaijan, no. 81553/12, § 116, 4 February 2016).

    SHIOSHVILI AND OTHERS v. RUSSIA

    Auszug aus EGMR, 13.12.2018 - 66650/13
This finding makes it unnecessary to determine whether the interference pursued a legitimate aim and was necessary in a democratic society (see Sissanis v. L.B. v. LITHUANIA

An interference with a person's right to leave any country must be "in accordance with law", pursue one or more of the legitimate aims set out in Article 2 § 3 of Protocol No. 4 and be "necessary in a democratic society" to achieve such an aim (see Mursaliyev and Others v. Azerbaijan, nos. 66650/13 and 10 others, § 30, 13 December 2018, and the cases cited therein).
  • EGMR, 14.10.2021 - 74288/14

DEMOCRACY AND HUMAN RIGHTS RESOURCE CENTRE v. AZERBAIJAN and 1 other application

The relevant provisions of the domestic law relating to the right of a person to leave the country and Article 449 of the CCrP are described in detail in the Court's judgment Mursaliyev and Others v. Azerbaijan (nos. 66650/13 and 10 others, §§ 15-18, 13 December 2018).

The Court refers to the general principles established in its case-law and set out in the judgment Mursaliyev and Others v. Azerbaijan (nos. 66650/13 and 10 others, §§ 29-31, 13 December 2018), which are equally pertinent to the present case.

Having regard to the case of Mursaliyev and Others v. Azerbaijan (nos. 66650/13 and 10 others, 13 December 2018) the Government of the Republic of Azerbaijan hereby wishes to express - by way of unilateral declaration - acknowledgement of the fact that there has been a violation of the applicant's rights guaranteed under Article 2 of Protocol No. 4 to the Convention and Article 13 of the Convention.

The Court has established clear and extensive case-law in respect of Azerbaijan relating to the imposition of travel bans and the effectiveness of the domestic remedies in this regard (see Mursaliyev and Others v. Azerbaijan, nos. 66650/13 and 10 others, 13 December 2018).

  • EGMR, 11.07.2023 - 61365/16

    SERAJ EDDIN v. SERBIA

Rn. 76 In any event, for State interference with a person's right to leave any country to be justified, the strict conditions set out in Article 2 § 3 of Protocol No. 4 must be met, that is to say, the interference must be "in accordance with law", pursue one or more of the legitimate aims set out in that provision and be "necessary in a democratic society" to achieve such an aim (see, for example, Mursaliyev and Others v. Azerbaijan, nos. 66650/13 and 10 others, § 30, 13 December 2018, and the cases cited therein).

France, no 62740/00, § 71, 31 mars 2005, et Sud Est Réalisations c. France, no 6722/05, § 59, 2 décembre 2010).

France (déc.), no 13829/03, 3 juillet 2007).

  • EGMR, 18.12.1986 - 9697/82
France, 20 février 1991, § 27, série A no 198, Johnston et autres c. Irlande, 18 décembre 1986, § 45, série A no 112, et Veysel Şahin c. Turquie, no 4631/05, § 21, 27 septembre 2011).

Anforderungen an die unverzügliche Vorführung der festgenommenen Person i.S.d. …

Malte [GC], no 25642/94, § 39, CEDH 1999-III).

    Auszug aus EGMR, 13.12.2018 - 67944/13

    SUD EST REALISATIONS AGAINST FRANCE

Moldova, no 49806/99, § 53, CEDH 2004-III (extraits), Cocchiarella c. Italie [GC], no 64886/01, § 90, CEDH 2006-V, Tchokontio Happi c. France, no 65829/12, § 50, 9 avril 2015, Casa di Cura Valle Fiorita S.r.l. c. Italie, no 67944/13, § 54, 13 décembre 2018, et M.K. et autres, précité, § 153).
  • EGMR, 14.10.2021 - 38100/15

    ZIBRAT v. CROATIA

The Court sees no reason to hold otherwise as it has itself frequently found violations of Article 6 § 1 of the Convention in cases raising similar issues as the present one (see, for example, Cvijetić v. Croatia, no. 71549/01, §§ 32-37 and 40-43, 26 February 2004; Pibernik v. Croatia, no. 75139/01, §§ 48-50 and 56-60, 4 March 2004, and Casa di Cura Valle Fiorita S.r.l. v. • EGMR, 11.06.2026 - 24104/20

INDUSTRIALI COSTRUZIONI MECCANICHE TOR CERVARA S.R.L. c. ITALIE

Italie, no 67944/13, § 33, 13 décembre 2018).
  • EGMR, 03.12.2020 - 12929/18

PAPACHELA ET AMAZON S.A. c.
