LABITA c. ITALIE
Italie [GC], no 26772/95, § 153, CEDH 2000-IV). - EGMR, 27.06.1968 - 2122/64
Wemhoff ./. Deutschland
Allemagne, 27 juin 1968, § 9, série A no 7). - EGMR, 03.10.2006 - 543/03
Royaume-Uni [GC], no 543/03, § 43, CEDH 2006-X).

Suisse, 26 janvier 1993, § 30, série A no 254-A). - EGMR, 28.03.1990 - 11968/86
Autriche, 28 mars 1990, §§ 36-39, série A no 175). - EGMR, 04.05.2006 - 17584/04
CELEJEWSKI v. POLAND
Pologne, no 17584/04, 4 mai 2006).
- EGMR, 17.04.2012 - 20071/07
[ENG]
Even though he was acquitted in the second set of proceedings involving the charges of robbery, theft and unlawful detention (see paragraph 31 above), the Court considers that the fact that the two other cases concerned organised crime should be taken into account in assessing compliance with Article 5 § 3 in the present case (see Bak v. Poland, no. 7870/04, § 57, 16 January 2007). - EGMR, 20.07.2021 - 19699/18
AKGÜN c. TURQUIE
Pologne, no 7870/04, § 56, 16 janvier 2007, Štvrtecký c. Slovaquie, no 55844/12, 61, 5 juin 2018, et Podeschi c. Saint-Marin, 66357/14, § 149, 13 avril 2017). - EGMR, 26.03.2013 - 43808/07
[ENG]
In the Court's view, the fact that the case concerned a member of such a criminal group should be taken into account in assessing compliance with Article 5 § 3 (see Bak v. Poland, no. 7870/04, § 57, 16 January 2007).To further bolster its organised-crime-related rationale, the majority cites Bak v. Poland, no. 7870/04, § 57, 16 January 2007, which in turn relies on Celejewski v. Poland, no. 17584/04, § 37, 4 May 2006.

PIOTR BARANOWSKI v. POLAND
The judgment in Bak v. Poland, no. 7870/04, §§ 38-40, 16 January 2007, addresses the issue of domestic practice in the area of pre-trial detention and organised crime in particular.Such detention cannot be considered on the same footing as a detention under Article 5 § 1 (c), with which Article 5 § 3 is solely concerned, as it applies only to persons in custody awaiting their trial (see Wemhoff v. Germany, judgment of 27 June 1968, Series A no. 7, pp. 23-24, § 9, and Bak v. Poland, no. 7870/04, § 54, 16 January 2007).

PAWLAK v. POLAND
The judgment Bak v. Poland, no. 7870/04, §§ 38-40, 16 January 2007, addresses more specifically the issue of domestic practice in the area of pre-trial detention and organised crime.Such detention cannot be considered on the same footing as a detention under Article 5 § 1 (c), with which Article 5 § 3 is solely concerned, as it applies only to persons in custody awaiting their trial (see Wemhoff v. Germany, judgment of 27 June 1968, Series A no. 7, pp. 23-24, § 9 and Bak v. Poland, no. 7870/04, judgment of 16 January 2007, § 54).

Türkei verurteilt: Nicht jeder ist ein Terrorist
Despite the parties' submissions, the subsequent period, from 30 November 2007 until the applicant's release on 15 November 2011, cannot be taken into consideration for the purposes of Article 5 § 3 of the Convention because the applicant's detention on remand during that period, pursuant to section 7(2) of Law no. 3713, coincided with his detention after his conviction for membership of an illegal organisation under Article 314 § 2 of the Criminal Code (see Bąk v. Poland, no. 7870/04, § 54, 16 January 2007; Ürfi Çetinkaya v. Turkey, no. 19866/04, § 124, 23 July 2013; and Çakar v. Turkey (dec.), no. 47749/11, 10 December 2013). - EGMR, 18.12.2007 - 13167/02
RYDZ v. POLAND
The judgment Bak v. Poland, no. 7870/04, §§ 38-40, 16 January 2007, addresses more specifically the issue of domestic practice in the area of pre-trial detention and organised crime. The Court recalls that, in view of the essential link between Article 5 § 3 of the Convention and paragraph 1 (c) of that Article, a person convicted at first instance cannot be regarded as being detained "for the purpose of bringing him before the competent legal authority on reasonable suspicion of having committed an offence" and that the detention coinciding with detention after conviction in separate criminal proceedings cannot be considered on the same footing as a situation of a person in custody awaiting his trial (see Wemhoff v. Germany, judgment of 27 June 1968, Series A no. 7, pp. 23-24, § 9, B. v. Austria, judgment of 28 March 1990, Series A no. 175, pp. 14-16, §§ 36-39, Bak v. Poland, no. 7870/04, judgment of 16 January 2007, § 54).

The Court may intervene only in situations where the rights and liberties guaranteed under the Convention have been infringed (see Bak v. Poland, no. 7870/04, § 59, ECHR 2007-II (extracts)). - EGMR, 22.01.2008 - 7033/06
TEODORSKI v.
