  • EGMR, 15.07.1982 - 8130/78

    Eckle ./. Deutschland

    Auszug aus EGMR, 13.09.2016 - 50541/08
A "criminal charge" exists from the moment that an individual is officially notified by the competent authority of an allegation that he has committed a criminal offence, or from the point at which his situation has been substantially affected by actions taken by the authorities as a result of a suspicion against him (see Deweer v. Belgium, 27 February 1980, §§ 42-46, Series A no. 35; Eckle v. Germany, 15 July 1982, § 73, Series A no. 51; and McFarlane v. Ireland (GC), no. 31333/06, § 143, 10 September 2010).

The three case-law authorities cited by the judgment (namely Deweer v. Belgium, 27 February 1980, § 42-46, Series A no. 35; Eckle v. Germany, 15 July 1982, § 73, Series A no. 51; and McFarlane v. Ireland (GC), no. 31333/06, § 143, 10 September 2010) do not formulate the text, as the judgment does (at paragraph 249), as being whether "(an individual's) situation has been substantially affected by actions taken by the authorities as a result of a suspicion against him" (emphasis supplied).

    Auszug aus EGMR, 13.09.2016 - 50541/08

  • EGMR, 21.12.2000 - 34720/97

    HEANEY ET McGUINNESS c. IRLANDE

    Auszug aus EGMR, 13.09.2016 - 50541/08
For this reason, the Court must first consider the nature and degree of compulsion used to obtain the evidence (see Heaney and McGuinness v. Ireland, no. 34720/97, §§ 54-55, ECHR 2000-XII; O'Halloran and Francis, cited above, § 55; and Bykov, cited above, § 92).

The Court has stressed the importance of adhering to the Convention values in a similar context in respect of Article 6 (see Heaney and McGuinness v. Ireland, no. 34720/97, ECHR 2000"XII, where the Court found that the security and public-order concerns invoked by the respondent Government could not justify a provision which extinguished the very essence of the applicants' rights to silence and against self-incrimination; see also Salduz v. Turkey (GC), no. 36391/02, ECHR 2008, and El Haski v. Belgium, no. 649/08, 25 September 2012).

  • EGMR, 24.11.1993 - 13972/88

    IMBRIOSCIA c. SUISSE

    Auszug aus EGMR, 13.09.2016 - 50541/08
    (c) Article 6 and pre-trial proceedings 253. The primary purpose of Article 6 as far as criminal matters are concerned is to ensure a fair trial by a "tribunal" competent to determine "any criminal charge" (see Imbrioscia v. Switzerland, 24 November 1993, § 36, Series A no. 275; Brennan v. the United Kingdom, no. 39846/98, § 45, ECHR 2001"X; Shabelnik v. Ukraine, no. 16404/03, § 52, 19 February 2009; and Dvorski, cited above, § 76).

The Court has recognised that the fairness of the trial is likely to be seriously prejudiced by an initial failure to comply with its provisions, especially in regard to the rights mentioned in Article 6 § 3 (see Imbrioscia v. Switzerland, 24 November 1993, § 36, Series A no. 275; Salduz, § 50, and, most recently, Dvorski v. Croatia, cited above, § 76).

  • EGMR, 16.06.2015 - 41269/08

    [FRE]

    Auszug aus EGMR, 13.09.2016 - 50541/08
In Schmid-Laffer v. Switzerland, no. 41269/08, §§ 29 and 39, 16 June 2015, the Court noted that when the applicant was first interviewed by the police there was nothing in the case-file to suggest that she should have been treated as a person accused of an offence and should have been informed of her right to remain silent.

The judgment proceeds on the basis that in order for the Court to be able to take account of the initial statements made by the applicants to the police when assessing the fairness of their trial, it must imperatively be established that Article 6 was already applicable at the time that they made their statements (see Schmid-Laffer v. Switzerland, no. 41269/08, §§ 26-32, 16 June 2015, which appears to reason on a similar basis); in other words that a "criminal charge" within the autonomous meaning of Article 6 had been laid when the "safety" interviews of the first three applicants were carried out and at the very moment when the fourth applicant began to incriminate himself, thereby turning himself from a witness into a suspect.

  • EGMR, 30.09.1985 - 9300/81
    Auszug aus EGMR, 13.09.2016 - 50541/08
Compliance with the requirements of a fair trial must be examined in each case having regard to the development of the proceedings as a whole and not on the basis of an isolated consideration of one particular aspect or one particular incident, although it cannot be excluded that a specific factor may be so decisive as to enable the fairness of the trial to be assessed at an earlier stage in the proceedings (see Can v. Austria, no. 9300/81, Commission's report of 12 July 1984, § 48, Series A no. 96).

After all, it is "the evidence obtained during the decisive early stage of the investigation (that) determines the framework in which the offence charged will be considered at the trial (see Can v. Austria, no. 9300/81, Commission's report of 12 July 1984, § 50, Series A no. 96)" (Salduz, § 54).

    {FN:14} EGMR, 13. September 2016, 1brahim u. a./Vereinigtes Königreich (CE:ECHR:2016:0913JUD005054108, § 272).

September 2016, 1brahim u. a./Vereinigtes Königreich, CE:ECHR:2016:0913JUD005054108, §§ 266 und 272).

    {FN:16} EGMR, 13. September 2016, 1brahim u. a./Vereinigtes Königreich (CE:ECHR:2016:0913JUD005054108, § 266).

September 2016, 1brahim u. a./Vereinigtes Königreich, CE:ECHR:2016:0913JUD005054108, §§ 254 und 274).

September 2016, 1brahim u. a./Vereinigtes Königreich, CE:ECHR:2016:0913JUD005054108, § 274).

RUSISHVILI v. GEORGIA

The relevant general principles concerning access to a lawyer and, more specifically, representation by a lawyer of one's choosing have been summarised by the Court in the case of Ibrahim and Others v. the United Kingdom ([GC], nos. 50541/08 and 3 others, §§ 255-74, 13 September 2016) and Dvorski v. Croatia ([GC], no. 25703/11, § 76-82, ECHR 2015) respectively (for a more recent reference see also Simeonovi v. Bulgaria [GC], no. 21980/04, §§ 112-20, 12 May 2017, and Beuze v. Belgium [GC], no. 71409/10, §§ 114-50, 9 November 2018).

Complaints under Article 6 about the investigation stage tend to crystallise at the trial itself when the prosecution seeks to rely on evidence obtained during the pre-trial proceedings - the phase in which the restrictions on Article 6 rights applied - and the defence seeks its exclusion (see Ibrahim and Others v. the United Kingdom [GC], nos. 50541/08 et 3 others, § 254, 13 September 2016 and Beuze, cited above, § 173).

50541/08 and 3 others, § 255, 13 September 2016), and the rights under the Convention have to be ensured in such a way that they are not "theoretical or illusory" but "practical and effective" (see Salduz, cited above, § 51, with further references).

  • EGMR, 23.10.2018 - 38740/09

    DUMAN v. TURKEY

On 7 October 2016 the Court invited the Government to submit further observations, if they so wished, following the judgment in Ibrahim and Others v. the United Kingdom ([GC], nos. 50541/08 and 3 others, ECHR 2016).

Nor have they demonstrated that the absence of legal assistance at the initial stage of the investigation did not irretrievably prejudice the applicant's defence rights (see Salduz, cited above, § 58, and Ibrahim and Others v. the United Kingdom [GC], nos. 50541/08 and 3 others, § 274.) In that respect, the Court notes that in convicting him, the first-instance court relied on, inter alia, the evidence collected in the absence of a lawyer during the applicant's twenty-two days' detention, such as his statements to the police and the public prosecutor and his statements taken during the reconstruction of events and the on-site inspections.

  • EGMR, 23.01.2018 - 15185/05

    ÇELIK v. TURKEY

On 7 October 2016 the Vice-President of the Second Section invited the Government to submit further observations, if they so wished, following the judgment in Ibrahim and Others v. the United Kingdom ([GC], nos. 50541/08 and 3 others, ECHR 2016).

The Court does not consider it necessary to examine whether the systematic nature of the restriction on the applicant's right of access to a lawyer was, in itself, sufficient to find a violation of Article 6 §§ 1 and 3 (c) of the Convention, as, in any event, the Government have not offered any compelling reasons for the restriction or demonstrated that the absence of legal assistance at the initial stage of the investigation did not irretrievably prejudice the applicant's defence rights (Salduz, cited above, § 58; and Ibrahim and Others v. the United Kingdom [GC], nos. 50541/08 and 3 others, § 274.) In that respect, the Court notes that in convicting him, the first-instance court relied on the applicant's statements to the police.

  • EGMR, 04.09.2018 - 28338/07

    GÜNER v. TURKEY

On 17 February 2017 the Vice-President of the Second Section invited the Government to submit further observations, if they so wished, following the judgment in Ibrahim and Others v. the United Kingdom ([GC], nos. 50541/08 and 3 others, ECHR 2016).

The Court does not consider it necessary to examine whether the systematic nature of the restriction on the applicant's right of access to a lawyer was, in itself, sufficient to find a violation of Article 6 §§ 1 and 3 (c) of the Convention, as, in any event, the Government have not offered any compelling reasons for the restriction or demonstrated that the absence of legal assistance at the initial stage of the investigation did not irretrievably prejudice the applicant's defence rights (ibid., § 58, and see Ibrahim and Others v. the United Kingdom ([GC], nos. 50541/08 and 3 others, § 274, ECHR 2016).

  • EGMR, 13.11.2018 - 48719/08

    SIMSEK v. TURKEY

On 17 February 2017 the Vice-President of the Second Section invited the Government to submit further observations, if they so wish, following the judgment in Ibrahim and Others v. the United Kingdom [GC], (nos. 50541/08 and 3 others, ECHR 2016).

The Court does not consider it necessary to examine whether the systematic nature of the restriction on the applicant's right of access to a lawyer was, in and of itself, sufficient to find a violation of Article 6 §§ 1 and 3 (c) of the Convention, as, in any event, the Government have not offered any compelling reasons for the restriction or demonstrated that the absence of legal assistance at the initial stage of the investigation did not irretrievably prejudice the applicants defence rights (see Salduz, cited above, § 58, and Ibrahim and Others v. the United Kingdom [GC], nos. 50541/08 and 3 others, § 274.) In that regard, the Court notes that in convicting him the first-instance court relied on the applicant's statements to the police.

  • EGMR, 15.10.2019 - 1399/07

    MEHMET ALI ESER v. TURKEY

On 7 October 2016 the Vice-President of the Second Section invited the Government to submit further observations, if they so wished, following the judgment in Ibrahim and Others v. the United Kingdom ([GC], nos. 50541/08 and 3 others, 13 September 2016).

The general principles with regard to access to a lawyer, the right to remain silent, the privilege against self-incrimination, and the relationship of those rights with the overall fairness of the proceedings under the criminal limb of Article 6 of the Convention can be found in Beuze v. Belgium ([GC], no. 71409/10, §§ 119-50, 9 November 2018), and Ibrahim and Others v. the United Kingdom ([GC], nos. 50541/08 and 3 others, §§ 249-74, 13 September 2016).

    ISIK v. TURKEY

On 12 October 2016 the Vice-President of the Second Section invited the Government to submit further observations, if they wished, in the light of the judgment in Ibrahim and Others v. the United Kingdom ([GC], nos. 50541/08 and 3 others, ECHR 2016).

The Court does not consider it necessary to examine whether the systematic nature of the restriction on the applicant's right of access to a lawyer was, in itself, sufficient to find a violation of Article 6 §§ 1 and 3 (c) of the Convention, as, in any event, the Government have not offered any compelling reasons for the restriction or demonstrated that the absence of legal assistance at the initial stage of the investigation did not irretrievably prejudice the applicant's defence rights (see Salduz, cited above, § 58, and Ibrahim and Others v. the United Kingdom ([GC], nos. 50541/08 and 3 others, § 274, ECHR 2016).

Referring to the Court's judgment in the case of Salduz v. Turkey ([GC] no. 36391/02, ECHR 2008) and Ibrahim and Others v. the United Kingdom ([GC], nos. 50541/08 and 3 others, ECHR 2016), the Government suggested in a broad manner that there were compelling reasons for delaying access to legal assistance arising from the potential loss of life on a large scale and the urgent need to obtain information on possible planned attacks as well as the severe practical constraints under which the police were operating.

Wirksamkeitsverpflichtete Konventionsauslegung; Recht auf konkreten und wirksamen …

    Auszug aus EGMR, 16.12.2014 - 50541/08
The applicants in the present joined cases argued (see paragraph 169 of the judgment) that "the right to legal advice was not merely a protection against coercion and ill-treatment: there was a clear link between the right to legal advice and the right against self-incrimination running through the case-law of the Court both before and after Salduz" (see Salduz v. Turkey ([GC], no. 36391/02, ECHR 2008).

    HEANEY ET McGUINNESS c. IRLANDE

    Auszug aus EGMR, 16.12.2014 - 50541/08
"Their rationale lies, inter alia, in the protection of the accused against improper compulsion by the authorities, thereby contributing to the avoidance of miscarriages of justice and to the fulfilment of the aims of Article 6. The right not to incriminate oneself, in particular, presupposes that the prosecution in a criminal case seek to prove their case against the accused without resort to evidence obtained through methods of coercion or oppression in defiance of the will of the accused (see, inter alia, Saunders v. the United Kingdom [GC], 17 December 1996, § 68, Reports 1996-VI; Heaney and McGuinness v. Ireland, no. 34720/97, § 40, ECHR 2000-XII; and the judgment in Jalloh, cited above, § 100).".

    [ENG]

    Auszug aus EGMR, 16.12.2014 - 50541/08
It is true that in Titarenko v. Ukraine, no. 31720/02, § 87, 20 September 2012, the Court did not consider the fact that the applicant there had repeated his confession in the presence of his lawyer to undermine its finding that his rights had been irretrievably prejudiced.
  • EGMR, 10.03.2009 - 4378/02

In making this evaluation the Court looks at the proceedings as a whole, having regard to whether the rights of the defence have been respected (see, for example, Bykov v. Russia [GC], no. 4378/02, § 90, 10 March 2009; Gäfgen, cited above, § 164; Lutsenko v. Ukraine, no. 30663/04, § 42, 18 December 2008; and Aleksandr Zaichenko, cited above, § 57).
  • EGMR, 24.09.2009 - 7025/04
    Auszug aus EGMR, 16.12.2014 - 50541/08
But they are not an end in themselves: compliance with the requirements of a fair trial must be examined in each case having regard to the development of the proceedings as a whole, and not on the basis of the isolated consideration of one particular aspect or incident (see Pishchalnikov v. Russia, no. 7025/04, § 64, 24 September 2009. See also Mayzit, cited above, § 77; and Seleznev, cited above, § 67).

    IMBRIOSCIA c. SUISSE

    Auszug aus EGMR, 16.12.2014 - 50541/08
    The Court's primary concern under Article 6 § 1 is to evaluate the overall fairness of the criminal proceedings (see Imbrioscia v. Switzerland, 24 November 1993, § 38, Series A no. 275; Taxquet v. Belgium [GC], no. 926/05, § 84, 16 November 2010; and Bandaletov v. Ukraine, no. 23180/06, § 54, 31 October 2013).

On a proper reading of the Court's case-law, particularly Aleksandr Zaichenko v. Russia, no. 39660/02, 18 February 2010, what was necessary was that, at trial, the accused should have an opportunity to challenge the use of the statement, its reliability should be assessed, the fairness of admitting it should be considered and the trial court should give reasons for its decisions.
  • EGMR, 13.10.2009 - 7377/03

    [FRE]

    Auszug aus EGMR, 16.12.2014 - 50541/08
It is important to note, first, that the present case is different from the case of Salduz as the absence of a lawyer during the applicants" initial police questioning did not result from the systemic application of a legal provision (see Sedal v. Turkey (dec.), no. 38802/08, § 33, 13 May 2014; compare Dayanan v. Turkey, no. 7377/03, § 33, 13 October 2009; and Çimen v. Turkey, no. 19582/02, § 26, 3 February 2009).

    SELEZNEV v. RUSSIA

    Auszug aus EGMR, 16.12.2014 - 50541/08
Their intrinsic aim is to contribute to ensuring the fairness of the criminal proceedings as a whole (see Mayzit v. Russia, no. 63378/00, § 77, 20 January 2005; and Seleznev v. Russia, no. 15591/03, § 67, 26 June 2008).
