Finlande [GC], no 25702/94, § 154, CEDH 2001-VII, Kutzner c. Allemagne, no 46544/99, § 65, CEDH 2002-I, P., C. et S. c. Royaume-Uni, no 56547/00, § 114, CEDH 2002-VI, S. et Marper c. Royaume-Uni [GC], nos 30562/04 et 30566/04, § 101, CEDH 2008, S.H. et autres c. Autriche [GC], no 57813/00, § 91, CEDH 2011, Piechowicz c. Pologne, no 20071/07, § 212, 17 avril 2012, Hanzelkovi c. République tchèque, no 43643/10, § 72, 11 décembre 2014, Parrillo c. Italie [GC], no 46470/11, § 168, CEDH 2015, Zaieţ c. Roumanie, no 44958/05, § 50, 24 mars 2015, Medžlis Islamske Zajednice Brčko et autres c. Bosnie-Herzégovine [GC], no 17224/11, §§ 89, 121, 27 juin 2017, et Pavel Shishkov c. Russie, no 78754/13, §§ 95-97, 2 mars 2021).

Autriche [GC], no 57813/00, § 91, CEDH 2011, 01sson c. Suède (no 1), 24 mars 1988, § 68, série A no 130, K. et T. c. Finlande [GC], no 25702/94, § 154, CEDH 2001-VII, Kutzner c. Umgang mit Embryonen strikt geregelt

The Court reiterates that in determining whether an impugned measure was "necessary in a democratic society", it will consider whether, in the light of the case as a whole, the reasons adduced to justify that measure were relevant and sufficient for the purposes of paragraph 2 of Article 8 (see, among many other authorities, S.H. and Others, cited above § 91; Olsson v. Sweden (no. 1), 24 March 1988, § 68, Series A no. 130; K. and T. v. Finland [GC], no. 25702/94, § 154, ECHR 2001-VII; Kutzner v. Germany, no. 46544/99, § 65, ECHR 2002-I; and P., C. and S. v. the United Kingdom, no. 56547/00, § 114, ECHR 2002-VI).
  • EGMR, 10.09.2019 - 37283/13

STRAND LOBBEN AND OTHERS v. NORWAY

Royaume-Uni (déc.), no 56547/00, 11 décembre 2001).
  • EGMR, 31.01.2012 - 61226/08

    [FRE]

Royaume-Uni, requête no 56547/00, 16 juillet 2002, § 100).

Bulgarie, no 33738/02, §§ 45 et 52, 16 juillet 2009).

  • EGMR, 31.05.2011 - 35348/06

    [ENG]

The applicants had participated throughout the proceedings, (in contrast with B. v. the United Kingdom, 8 July 1987, Series A no. 121) and had been represented throughout (in contrast with P., C. and S. v. the United Kingdom, no. 56547/00, ECHR 2002-VI).

For these reasons, measures which deprive biological parents of the parental responsibilities and authorise adoption should only be applied in exceptional circumstances and can only be justified if they are motivated by an overriding requirement pertaining to the child's best interests (see Aune v. Norway, no. 52502/07, § 66, 28 October 2010; Johansen, cited above, § 78 and, mutatis mutandis, P., C. and S. v. the United Kingdom, no. 56547/00, § 118, ECHR 2002-VI).

  • EGMR, 31.05.2016 - 2430/06

    GANKIN v. RUSSIA

From the Convention standpoint, an applicant does not need to show that his absence from a hearing resulted in actual prejudice or affected the outcome of the proceedings, for such a requirement would deprive the guarantees of Article 6 of their substance (see P., C. and S. v. the United Kingdom, no. 56547/00, § 96, ECHR 2002-VI, and Artico v. Italy, 13 May 1980, § 35, Series A no. 37).
  • EGMR, 22.12.2020 - 64639/16

    M.L. v. NORWAY

As to whether the reasons provided by the District Court were also sufficient to justify the impugned measures, the Court firstly reiterates that it has previously refrained from attempting to untangle the opposing considerations inherent in questions concerning whether adoption or long-term foster care may be in the best interests of a child in a specific case (see, in particular, P., C. and S. v. the United Kingdom, no. 56547/00, § 136, ECHR 2002-VI; and Pedersen and Others, cited above, § 65), and is not inclined to take a different approach in respect of the instant case.
  • EGMR, 05.07.2016 - 44898/10

    JERONOVICS v. LATVIA

The same is true as regards the principles governing the granting of legal aid as a component of the right of access to a court (see, for example, Aerts v. Belgium, 30 July 1998, §§ 59-60, Reports of Judgments and Decisions 1998-V; P., C. and S. v. the United Kingdom, no. 56547/00, §§ 88-91, ECHR 2002-VI; Bertuzzi v. France, no. 36378/97, §§ 23-32, ECHR 2003-III; and Staroszczyk v. Poland, no. 59519/00, §§ 127-129, 22 March 2007).

    SCOZZARI ET GIUNTA c. ITALIE

    Auszug aus EGMR, 11.12.2001 - 56547/00
Similarly, this case could be distinguished from the case of Scozzari and Giunta v. Italy ([GC] nos. 39221/98 and 41963/98, ECHR 2000-VIII), where the birth mother's rights had only been temporarily suspended and was in dispute with the local authority as to their compliance with the Convention regarding her children in care.

The Court finds that the key consideration in such a case as the present is that any serious issues concerning respect for a child's rights should be examined (see, mutatis mutandis, Scozzari and Giunta v. Italy [GC], nos. 39221/98 and 41963/98, ECHR 2000-VIII, § 138).

    LOIZIDOU c. TURQUIE (EXCEPTIONS PRÉLIMINAIRES)

    Auszug aus EGMR, 11.12.2001 - 56547/00
The Court re-iterates the principle that the object and purpose of the Convention as an instrument for the protection of individual human beings requires that its provisions, both procedural and substantive, be interpreted and applied so as to render its safeguards both practical and effective (see amongst other authorities, Loizidou v. Turkey judgment of 23 March 1995, Series A no. 310, pp.
  • EGMR, 26.10.1988 - 10581/83
    Auszug aus EGMR, 11.12.2001 - 56547/00
National rules in this respect may serve purposes different from those contemplated by Article 34 and, while those purposes may sometimes be analogous, they need not always be so (see, mutatis mutandis, the Norris v. Ireland judgment of 26 October 1988, Series A no. 142, p. 15, § 31).
  • EGMR, 19.03.1991 - 11069/84
    Auszug aus EGMR, 11.12.2001 - 56547/00
The complaints intended to be made subsequently before the Court should have been made to the appropriate domestic body, at least in substance and in compliance with the formal requirements laid down in domestic law and, further, that any procedural means that might prevent a breach of the Convention should have been used (see the Cardot v. France judgment of 19 March 1991, Series A no. 200, p. 18, § 34).
  • EKMR, 20.05.1996 - 23715/94

    S.P., D.P. and A.T. v. THE UNITED KINGDOM

    Auszug aus EGMR, 11.12.2001 - 56547/00
As the Commission has previously pointed out, the position of children under Article 34 (formerly Article 25) qualifies for careful consideration, as children must generally rely on other persons to present their claims and represent their interests, and may not be of an age or capacity to authorise any steps to be taken on their behalf in any real sense (no. 23715/94, S.P., D.P. and T. v. the United Kingdom, decision of 20 May 1996, unpublished, Commission report of 11 April 1997, DR 89-A, p. 31).
