The Court has also found that placing a convict in a particular penal facility may raise an issue under Article 8 of the Convention if its effects on his or her private and family life go beyond the 'normal' hardships and restrictions inherent in the very concept of imprisonment (see Khodorkovskiy and Lebedev v. Russia, nos. 11082/06 and 13772/05, § 837, 25 July 2013), and that, in that case, given the geographical situation of remote penal facilities and the realities of the Russian transport system, both prisoners sent to serve a sentence far from their home and members of their families suffered from the remoteness of the facilities (ibid., § 838).As a result, the applicants received fewer visits from their families (see Khodorkovskiy and Lebedev v. Russia, nos. 11082/06 and 13772/05, § 838, 25 July 2013).
In this connection, the Court's case-law shows different approaches: whereas in Navalnyy and Ofitserov v. Russia (nos. 46632/13 and 28671/14, § 129, 23 February 2016) and Navalnyye v. Russia (no. 101/15, §§ 88-89, 17 October 2017), in the circumstances relevant to those cases, the Court rejected complaints under Article 18 raised in conjunction with Articles 6 and 7 as incompatible ratione materiae with the provisions of the Convention, in Năstase v. Romania ((dec.), no. 80563/12, §§ 105-09, 18 November 2014), it rejected as manifestly ill-founded a complaint under Article 18 raised in conjunction with Article 6. By contrast, in Khodorkovskiy v. Russia (no. 2) (no. 11082/06, § 16, 8 November 2011) and Lebedev v. Russia (no. 2) (no. 13772/05, §§ 310-14, 27 May 2010), the Court declared admissible the applicants' complaints under Article 18 raised in conjunction with Articles 5, 6, 7 and 8 and subsequently, having examined the merits of those complaints in its judgment in Khodorkovskiy and Lebedev v. Russia (cited above, §§ 897-909), found no violation of Article 18 of the Convention.

YALÇINKAYA v. TURKEY
- EGMR, 17.10.2017 - 101/15
Urteile gegen Brüder Nawalny "willkürlich"
It considers that such an interpretation could not be said to have constituted a development consistent with the essence of the offence (see Liivik, cited above, §§ 100-01, and Huhtamäki, cited above, § 51; cf. Khodorkovskiy and Lebedev v. Russia, nos. 11082/06 and 13772/05, §§ 788 et seq., 25 July 2013).The Court has also allowed Article 18 to be invoked together with one of these three provisions and other Convention provisions, like Article 6. For example, in Khodorkovskiy and Lebedev v. Russia (nos. 11082/06 and 13772/05, 25 July 2013), the Court allowed the applicants to bring a complaint under Article 18 in conjunction with Articles 5, 6, 7 and 8. Although the Court cautioned that when allegations of improper State motives are made the Court must show particular diligence, it nevertheless scrutinised the State's motives and undertook an assessment of the criminal proceedings in order to determine whether the State had violated Article 18 (ibid., §§ 897-909).
- EGMR, 16.11.2017 - 919/15
ILGAR MAMMADOV v. AZERBAIJAN
Furthermore, the Court observes that the question whether Article 6 of the Convention contains any express or implied restrictions which may form the subject of the Court's examination under Article 18 of the Convention remains open (compare, for example, Navalnyy and Ofitserov v. Russia, nos. 46632/13 and 28671/14, § 129, 23 February 2016, where, in the circumstances relevant to that case, it rejected as incompatible ratione materiae a complaint under Article 18 raised in conjunction with Articles 6 and 7; Năstase v. Romania (dec.), no. 80563/12, §§ 105-09, 18 November 2014, where it rejected as manifestly ill-founded a complaint under Article 18 raised in conjunction with Article 6; and Khodorkovskiy v. Russia (no. 2), no. 11082/06, § 16, 8 November 2011, and Lebedev v. Russia (no. 2), no. 13772/05, §§ 310-14, 27 May 2010, where it declared admissible the applicants' complaints under Article 18 raised in conjunction with Articles 5, 6, 7 and 8 and subsequently, having examined the merits of those complaints in the judgment of Khodorkovskiy and Lebedev v. Russia, nos.11082/06 and 13772/05, §§ 897-909, 25 July 2013, found no violation of Article 18).
As indicated in paragraph 261 of the Chamber judgment, in some cases the Court has applied Article 18 in conjunction with Article 6. In Năstase v. Romania (dec.), no. 80563/12, §§ 105-09, 18 November 2014, for example, a complaint raised under Article 18 in conjunction with Article 6 was examined and rejected as manifestly ill-founded; in Khodorkovskiy v. Russia (no. 2) (dec.), no. 11082/06, § 16, 8 November 2011, and Lebedev v. Russia (no. 2) (dec.), no. 13772/05, §§ 310-14, 27 May 2010, complaints under Article 18 in conjunction with Articles 5, 6, 7 and 8 were declared admissible; and subsequently in the judgment of Khodorkovskiy and Lebedev v. Russia, nos.
11082/06 and 13772/05, §§ 897-909, 25 July 2013, a violation of Article 18 in conjunction with these articles was not found.

ROOK v. GERMANY
579, 25. - EGMR, 23.02.2016 - 46632/13

Moldova, no. 35615/06, 13 November 2007; Gusinskiy v. Russia, no. 70276/01, ECHR 2004-IV; and Tymoshenko v. Ukraine, no. 49872/11, 30 April 2013.
- EGMR, 16.07.2026 - 20409/23
R.B. v. ITALY
Even so, in the light of the considerations outlined above, the Court considers that that application (i) was based on a reasonable evolutive interpretation of Article 600-ter § 1 of the CC, (ii) and was both compatible with its wording and "consistent with the essence of the offence" (see, mutatis mutandis, Khodorkovskiy and Lebedev v. Russia, nos. 11082/06 and 13772/05, § 821, 25 July 2013).Equally, a new interpretation of the scope of an existing offence may be reasonably foreseeable for the purposes of Article 7, provided that it is reasonable under domestic law and remains consistent with the "essence of the offence" (see Khodorkovskiy and Lebedev v. Russia, nos. 11082/06 and 13772/05, §§ 791-821, 25 July 2013, concerning a new interpretation of the concept of tax evasion, and - one should not be surprised! - Sacharuk, cited above, §§ 156-59, where the Court considered the judicial development concerning the notion of "major non-pecuniary damage to the State" to have been foreseeable).
That would not have raised an issue under Article 7 (compare, among many other authorities, Khodorkovskiy and Lebedev v. Russia, nos. 11082/06 and 13772/05, § 821, 25 July 2013; Total S.A. and Vitol S.A. v. France, nos.

Verletzung des Rechts auf ein faires Verfahren durch überlange Verfahrensdauer; …
Auszug aus EGMR, 08.11.2011 - 11082/06
Referring to the case of Ferrazzini v. Italy [GC] (no. 44759/98, ECHR 2001-VII), the Government submitted that "tax matters still form part of the hard core of public-authority prerogatives, with the public nature of the relationship between the taxpayer and the community remaining predominant" (§ 29). - EGMR, 20.02.2007 - 35865/03
Mohammed Ali Hassan Al-Moayad
Auszug aus EGMR, 08.11.2011 - 11082/06
As to the Government's formal objection, the Court reiterates that complaints lodged under the second sentence of Article 34 do not give rise to any issue of admissibility, including exhaustion of domestic remedies, under the Convention (see, mutatis mutandis, Ergi v. Turkey, 28 July 1998, § 105, Reports 1998-IV; Shamayev, Shamayev and Others v. Georgia and Russia, no. 36378/02, § 507, ECHR 2005-III; and Mohammed Ali Hassan Al-Moayad v. Germany (dec.), no. 35865/03, 20 February 2007). - EGMR, 23.11.1993 - 14032/88
POITRIMOL c. FRANCE
Auszug aus EGMR, 08.11.2011 - 11082/06
The Court recalls that "a waiver must, if it is to be effective for Convention purposes, be established in an unequivocal manner and be attended by minimum safeguards commensurate with its importance (see Poitrimol v. France, 23 November 1993, § 31, Series A no. 277-A).

CHAMAÏEV ET AUTRES c. GEORGIE ET RUSSIE
- EGMR, 18.01.2000 - 27618/95
PESTI AND FRODL v. AUSTRIA
Auszug aus EGMR, 08.11.2011 - 11082/06
27618/95 and 27619/95, 18 January 2000; Krombach v. France, no. 29731/96, §§ 96 et seq., ECHR 2001-II), but not the "fairness" of the appeal proceedings, which is within the realm of Article 6 of the Convention. - EGMR, 27.05.2010 - 13772/05
LEBEDEV v. RUSSIA (No. 2)
Auszug aus EGMR, 08.11.2011 - 11082/06
The Court reiterates that it has already found in respect of the applicant's co-defendant, Mr Lebedev, that a similar complaint, in so far as it related to the first criminal case against the applicant and Mr Lebedev, was premature (see Lebedev v. Russia (no. 2) (dec.), no. 13772/05, § 266, 27 May 2010). - EGMR, 16.09.2010 - 4176/03
DANILIN v. RUSSIA
Auszug aus EGMR, 08.11.2011 - 11082/06
The Government have not specified with sufficient clarity what other action or complaint would have been an effective remedy in their view (see Danilin v. Russia, no. 4176/03, § 35, 16 September 2010, with further references).
