PETREA v. ROMANIA
Roumanie, no 4792/03, 29 avril 2008 ; et Maciuca c. Roumanie, no 25763/03, 26 mai 2009).
Enfin, renvoyant à l'affaire Petrea c.

NILSEN AND JOHNSEN v. NORWAY

Roumanie, no 12934/02, §§ 13 et 24, 16 juillet 2009). - EGMR, 27.06.2000 - 28871/95

SPINU CONTRE LA ROUMANIE
- EGMR, 17.12.2013 - 14150/08
[ENG]
Relying on the Court's case-law (Petrea v. Romania, no. 4792/03, 29 April 2008; Maciuca v. Romania, no. 25763/03, 26 May 2009; Iamandi v. Romania, no. 25867/03, 1 June 2010; and Racareanu v. Romania, no. 14262/03, 1 June 2010), the Government argued that a complaint based on the provisions of the Execution of Sentences Act 2006 and raised before the judge responsible for the execution of prison sentences was an effective remedy in cases in which detainees alleged a lack of medical treatment in detention.Consequently, there is no other indication in the file allowing a reasonable conclusion to be drawn as to the time and manner in which the applicant contracted hepatitis (see mutatis mutandis, Iamandi v. Romania, no. 25867/03, § 65, 1 June 2010).
- EGMR, 13.11.2012 - 22362/06
[ENG]
It recalls that in numerous cases raising similar issues it has already found that, in the case of complaints about conditions of detention relating to structural issues such as overcrowding or dilapidated installations, given the specific nature of this type of complaint, the legal actions suggested by the Romanian Government, based on Ordinance no. 56/2003 and on Law no. 275/2006, did not constitute effective remedies (see, among others, Petrea, cited above, § 37; Eugen Gabriel Radu v. Romania, no. 3036/04, § 23, 13 October 2009; Iamandi v. Romania, no. 25867/03, § 49, 1 June 2010; Cucolas v. Romania, no. 17044/03, § 67, 26 October 2010; Ogica v. Romania, no. 24708/03, § 35, 27 May 2010; Dimakos v. Romania, no. 10675/03, § 38, 6 July 2010; and Goh v. Romania, no. 9643/03, §§ 43 to 45, 21 June 2011).The Court observes that it has already found violations of Article 3 of the Convention in similar cases, on account of the material conditions of detention in Jilava and Giurgiu prisons, especially with respect to overcrowding and lack of hygiene (see, among others, Bragadireanu v. Romania, no. 22088/04, § 92-98, 6 December 2007; Maciuca v. Romania, no. 25763/03, §§ 24-27, 26 May 2009; Jiga v. Romania, no. 14352/04, §§ 65-66, 16 March 2010; Iamandi v. Romania, no. 25867/03, §§ 59-62, 1 June 2010; Marcu v. Romania, no. 43079/02, §§ 62-64, 26 October 2010; and Flamînzeanu v. Romania, no. 56664/08, § 98, 12 April 2011).
- EGMR, 24.07.2012 - 35972/05
[ENG]
The Court has frequently found a violation of Article 3 of the Convention on account of the lack of personal space afforded to detainees and unsatisfactory sanitary conditions (see, in particular, Ciorap v. Moldova, no. 12066/02, § 70, 19 June 2007; Kalashnikov v. Russia, no. 47095/99, §§ 97 et seq., ECHR 2002-VI; Bragadireanu v. Romania, no. 22088/04, §§ 92-98, 6 December 2007; and Iamandi v. Romania, no. 25867/03, §§ 56-62, 1 June 2010).
- EGMR, 17.07.2012 - 14337/04
[FRE]
In this connection, it observes that in recent applications against Romania concerning similar complaints it has already found that, given the specific nature of this type of complaint, the legal actions indicated by the Government, including a civil action in damages, did not constitute effective remedies (see Petrea, cited above, § 37; Eugen Gabriel Radu v. Romania, no. 3036/04, § 23, 13 October 2009; Iamandi v. Romania, no. 25867/03, § 49, 1 June 2010; Cucolas v. Romania, no. 17044/03, § 67, 26 October 2010; Ogica v. Romania, no. 24708/03, § 35, 27 May 2010; and Dimakos v. Romania, no. 10675/03, § 38, 6 July 2010).In previous cases where applicants have had at their disposal less than three square metres of personal space the Court has found that the overcrowding was so severe as to justify of itself a finding of a violation of Article 3 of the Convention (see, among many other authorities, Iamandi v. Romania, no. 25867/03, §§ 59-61, 1 June 2010; Racareanu v. Romania, no. 14262/03, §§ 49-52, 1 June 2010; and Flamînzeanu v. Romania, no. 56664/08, § 98, 12 April 2011).
- EGMR, 18.10.2011 - 13099/04
[ENG]
In this respect, it notes that in recent applications lodged against Romania and concerning similar complaints it has already found that, given the specific nature of this type of complaint, the legal actions suggested by the Government, including a general tort law action, do not constitute effective remedies (see Petrea, cited above, § 37; Eugen Gabriel Radu v. 10675/03, § 38, 6 July 2010).m per inmate - the Court has found a violation of Article 3 because the space factor was coupled with an established lack of ventilation, lighting or appropriate hygiene conditions (see, for example, Babushkin v. Russia, no. 67253/01, § 44, 18 October 2007; Ostrovar v. Moldova, no. 35207/03, § 89, 13 September 2005; Peers v. Greece, no. 28524/95, §§ 70-72, ECHR 2001-III; Flamînzeanu v. Romania, no. 56664/08, § 98, 12 April 2011, not final and Iamandi v. Romania, no. 25867/03, §§ 59-61, 1 June 2010), or lack of basic privacy in a prisoner's everyday life (see, mutatis mutandis, Belevitskiy v. Russia, no. 2967/01, §§ 73-79, 1 March 007; Valasinas, cited above, § 04; Khudoyorov v. Russia, no. 847/02, §§ 06 and 107, ECHR 2005-X (extracts); and Novoselov v. Russia, no. 66460/01, §§ 32, 40-43, 2 June 2005 and Iamandi, cited above, § 61).
- EGMR, 04.10.2011 - 31725/04
BADILA v. ROMANIA
In this connection, it observes that in recent applications against Romania concerning similar complaints it has already found that, given the specific nature of this type of complaint, the legal actions indicated by the Government, including the civil action in damages, did not constitute effective remedies (see Petrea, cited above, § 37; Eugen Gabriel Radu v. 10675/03, § 38, 6 July 2010).Even though there are no CPT reports concerning this specific establishment, the Court has recently analysed the material conditions of detention in this prison for periods of time which overlap with the period in which the applicant was detained there (see Iamandi v. Romania, no. 25867/03, §§ 56-62, 1 June 2010 and Bragadireanu v. Romania, no. 22088/04, §§ 92-98, 6 December 2007).

Roumanie, no 18999/04, § 34, 24 juillet 2012 et Ghavtadze c.
