IGNACCOLO-ZENIDE v. ROMANIA
Auszug aus EGMR, 15.05.2003 - 4783/03
In the matter of reuniting a parent with his or her children, Article 8 must be interpreted in the light of the Hague Convention, all the more so if the respondent State is a party to that instrument (see Iglesias Gil, cited above, § 51; Ignaccolo-Zenide v. Romania, no. 31679/96, § 95, ECHR 2000-I). - EGMR, 22.03.2001 - 34044/96
Schießbefehl
Auszug aus EGMR, 15.05.2003 - 4783/03
The Court also recalls that it must take the relevant rules of international law into account, particularly those relating to the international protection of human rights (see Iglesias Gil v. Spain, no. 56673/00, § 51, 29 April 2003; Streletz, Kessler and Krenz v. Germany [GC], nos. 34044/96, 35532/97 and 44801/98, § 90, ECHR 2001-II ; Al-Adsani v. the United Kingdom [GC], no. 35763/97, § 55, ECHR 2001-XI). - EGMR, 29.04.2003 - 56673/00
IGLESIAS GIL ET A.U.I. c. ESPAGNE
- EGMR, 23.09.1994 - 19823/92
HOKKANEN v. FINLAND
Auszug aus EGMR, 15.05.2003 - 4783/03
It follows from these considerations that the Court's task is not to take the place of the competent national authorities in regulating parents" rights, such as the right to exercise parental responsibility, the right of access or the right to determine a child's place of residence, but rather to review under the Convention the decisions taken by those authorities in the exercise of their power of appreciation (see, for example, mutatis mutandis, Hokkanen v. Finland, judgment of 23 September 1994, Series A no. 299-A, p. 20, § 55, and Bronda cited above, § 59). - EGMR, 24.02.1995 - 16424/90
McMICHAEL v. THE UNITED KINGDOM
Auszug aus EGMR, 15.05.2003 - 4783/03
The Court reiterates that the mutual enjoyment by parent and child of each other's company constitutes a fundamental element of family life and that domestic measures hindering such enjoyment amount to an interference with the right protected by Article 8 (see, among other authorities: McMichael v. the United Kingdom, judgment of 24 February 1995, Series A no. 307-B, p. 55, § 86; Johansen v. Norway, judgment of 7 August 1996, Reports of Judgments and Decisions 1996-III, p. 1001, § 52; and Bronda v. Italy, judgment of 9 June 1998, Reports 1998-IV, § 51). - EGMR, 12.07.1988 - 10862/84
SCHENK c. SUISSE
Auszug aus EGMR, 15.05.2003 - 4783/03
The Court recalls that its task under the Convention is to ascertain whether the proceedings as a whole were fair (see, mutatis mutandis, Schenk v. Switzerland, judgment of 12 July 1988, Series A no. 140, p. 29, §§ 45 and 46, and H. v. France, judgment of 24 October 1989, Series A no. 162-A, p. 23, §§ 60-61). - EGMR, 27.11.1992 - 13441/87
OLSSON c. SUÈDE (N° 2)
Auszug aus EGMR, 15.05.2003 - 4783/03
The Court further reiterates that a fair balance must be struck between the interests of the child and those of the parents (see, for example, Olsson v. Sweden (no. 2), judgment of 27 November 1992, Series A no. 250, pp.

Poland , Entscheidung vom 19.7.2016 - 2171/14 -, sowie in Sachen Paradis and Others v.
Poland , Entscheidung vom 19.7.2016 - 2171/14 -, sowie in Sachen Paradis and Others v. Germany , Entscheidung vom 15.5.2003 - 4783/03 -).

Turquie (déc.), no 14600/05, CEDH 2005-... (extraits) ; Monory, précité, § 73 ; Guichard c. France (déc.), no 56838/00, p. 414, CEDH 2003-X ; Paradis c. Allemagne, (déc.), no 4783/03, 15 mai 2003). - EGMR, 08.01.2009 - 41615/07
Neulinger und Shuruk ./. Schweiz
France, no 39388/05, §§ 58-83, CEDH 2007-..., Bianchi c. Suisse, no 7548/04, §§ 76-85, 22 juin 2006, Monory c. Roumanie et Hongrie, no 71099/01, §§ 69-85, 5 avril 2005, Eskinazi et Chelouche c.
