    BUDAYEVA ANDA OTHERS v. RUSSIA

Application no. 21166/02 by Fatima Khuseynovna ATMURZAYEVA against Russia lodged on 15 March 2002.

Having regard to the above applications lodged on 15 March 2002 (nos. 15339/02 and 21166/02), on 10 April 2002 (no. 20058/02), on 18 February 2002 (no. 11673/02) and on 9 March 2002 (no. 15343/02),.

The applicant in the second application (no. 21166/02), Mrs Fatima Khuseynovna Atmurzayeva, is a Russian national who was born in 1963 and lives in Tyrnauz (the second applicant).

  • EGMR, 17.11.2015 - 14350/05

    [FRE]

  • EGMR, 12.04.2016 - 64602/12

    R.B. v. HUNGARY

Indeed, where an applicant has a choice of remedies and their comparative effectiveness is not obvious, the Court tends to interpret the requirement of exhaustion of domestic remedies in the applicant's favour (see Budayeva and Others v. Russia, nos. 15339/02, 21166/02, 20058/02, 11673/02 and 15343/02, § 110, ECHR 2008 (extracts), and the cases cited therein).
  • EGMR, 02.02.2016 - 3648/04

    CAVIT TINARLIOGLU c. TURQUIE

France (déc.), no 69869/01, 1er mars 2005, Furdik c. Slovaquie (déc.), no 42994/05, 2 décembre 2008, Molie c. Roumanie (déc.), no 13754/02, § 39, 1er septembre 2009, et Vrábel c. Turquie (déc.), no 66309/09, § 14, 19 mai 2015, Ciechońska, précité, § 67).

Bulgarie, no 19202/03, § 73, 24 avril 2012).

  • EGMR, 01.09.2016 - 32514/12

    MIKHNO v. UKRAINE

The State authorities are also under an obligation to conduct a thorough and effective investigation capable of leading to the identification and punishment of those responsible (see, among other authorities, Budayeva and Others v. Russia, nos. 15339/02, 21166/02, 20058/02, 11673/02 and 15343/02, § 140, ECHR 2008 (extracts); Esmukhambetov and Others v. Russia, no. 23445/03, § 107, 29 March 2011; and Kolyadenko and Others v. Russia, nos.
  • EGMR, 04.10.2016 - 69546/12

    CEVRIOGLU v. TURKEY

The relevant regulations must also provide for appropriate procedures, taking into account the technical aspects of the activity in question, for identifying shortcomings in the processes concerned and any errors committed by those responsible at different levels (see Öneryıldız, cited above, §§ 89-90, and Budayeva and Others v. Russia, nos. 15339/02, 21166/02, 20058/02, 11673/02 and 15343/02, § 131-132, ECHR 2008 (extracts)).
  • EGMR, 20.10.2015 - 15529/12

    BALÁZS v.

  • EGMR, 23.06.2015 - 20620/10

    [FRE]

    15339/02, 21166/02, 20058/02, 11673/02 and 15343/02, § 111, ECHR 2008 (extracts); and Nencheva and Others v. Bulgaria, no. 48609/06, § 110, 18 June 2013).
  • EGMR, 03.12.2024 - 5576/19

    CEYHAN c. TURQUIE

  • EGMR, 19.12.2017 - 1227/06

TETYANA GAVRYLOVA AND DENYS GAVRYLOV v. UKRAINEand 4 other applications

The Court notes that it has found Article 2 applicable in a number of other cases where the complaints were raised by individuals, who happened to be fortuitous survivors of life-threatening incidents (see, for instance, Krivova v. Ukraine, no. 25732/05, § 45, 9 November 2010; Budayeva and Others v. Russia, nos. 15339/02, 21166/02, 20058/02, 11673/02 and 15343/02, § 146, ECHR 2008 (extracts); Kolyadenko and Others v.
