LABITA c. ITALIE
Auszug aus EGMR, 19.03.2009 - 30033/05
In cases under Articles 2 and 3 of the Convention, where the effectiveness of the official investigation is at issue, the Court has often assessed whether the authorities reacted promptly to the complaints at the relevant time (see Labita v. Italy [GC], no. 26772/95, § 133 et seq., ECHR 2000-IV).As the Court has stated on many occasions, ill-treatment must attain a minimum level of severity if it is to fall within the scope of Article 3. The assessment of this minimum is relative: it depends on all the circumstances of the case, such as the duration of the treatment, its physical and mental effects and, in some cases, the sex, age and state of health of the victim (see Labita v. Italy [GC], no. 26772/95, § 120, ECHR 2000-IV).
Where such grounds were "relevant" and "sufficient", the Court must also ascertain whether the competent national authorities displayed "special diligence" in the conduct of the proceedings (see Labita v. Italy [GC], no. 26772/95, §§ 152 and 153, ECHR 2000-IV).

Auszug aus EGMR, 19.03.2009 - 30033/05
The existence of a violation is conceivable even in the absence of prejudice or damage; the question whether an applicant has actually been placed in an unfavourable position or sustained damage becomes relevant only in the context of Article 41 (see, among many authorities, Religionsgemeinschaft der Zeugen Jehovas and Others v. Austria, no. 40825/98, § 67, 31 July 2008; Wassink v. the Netherlands, 27 September 1990, § 38, Series A no. 185-A; and Marckx v. A person charged with an offence must always be released pending trial unless the State can show that there are "relevant and sufficient" reasons to justify the continued detention (see, among other authorities, Castravet v. Moldova, no. 23393/05, §§ 30 and 32, 13 March 2007; McKay v. the United Kingdom [GC], no. 543/03, § 41, ECHR 2006-...; Jablonski v. Poland, no. 33492/96, § 83, 21 December 2000; and Neumeister v. Austria, 27 June 1968, § 4, Series A no. 8). - EGMR, 26.10.2006 - 59696/00
KHUDOBIN v. RUSSIA
Auszug aus EGMR, 19.03.2009 - 30033/05
The Court has frequently found a violation of Article 5 § 3 of the Convention in Russian cases where the domestic courts extended an applicant's detention relying essentially on the gravity of the charges and using stereotyped formulae without addressing specific facts or considering alternative preventive measures (see Belevitskiy, cited above, §§ 99 et seq.; Khudobin v. Russia, no. 59696/00, §§ 103 et seq., ECHR 2006-... ; Mamedova v. Russia, no. 7064/05, §§ 72 et seq., 1 June 2006; Dolgova, cited above, §§ 38 et seq.; Khudoyorov v. Russia, cited above, §§ 172 et seq.; Rokhlina v. Russia, cited above, §§ 63 et seq.; Panchenko v. Russia, cited above, §§ 91 et seq.; and Smirnova v. Russia, nos. - EGMR, 04.12.1995 - 18896/91
Auszug aus EGMR, 19.03.2009 - 30033/05
In respect of a person deprived of his liberty, any recourse to physical force which has not been made strictly necessary by his own conduct diminishes human dignity and is in principle an infringement of the right set forth in Article 3 of the Convention (see Sheydayev v. Russia, no. 65859/01, § 59, 7 December 2006; Ribitsch v. Austria, 4 December 1995, § 38, Series A no. 336; and Krastanov v. Bulgaria, no. 50222/99, § 53, 30 September 2004). - EGMR, 05.07.2001 - 38321/97
Fall E. gegen DEUTSCHLAND
Auszug aus EGMR, 19.03.2009 - 30033/05
However, it has already found, in similar circumstances, that the complexity of the case, the number or the conduct of the defendants could not justify more than five years" detention pending investigation and trial (see Erdem v. Germany, no. 38321/97, § 46, ECHR 2001-VII). - EGMR, 16.12.1999 - 24888/94

The question whether the purpose of the treatment was to humiliate or debase the victim is a further factor to be taken into account, but the absence of any such purpose cannot conclusively rule out a finding of a violation of Article 3 (see V. v. the United Kingdom [GC], no. 24888/94, § 71, ECHR 1999-IX). - EGMR, 24.07.2003 - 46133/99

- EGMR, 06.07.2023 - 21181/19
TULEYA v. POLAND
This is also true in respect of most of the guarantees of Article 6 § 1 of the Convention (with some exceptions concerning, for instance, the requirement of reasonable length of the proceedings, access to court, etc. - see, for example, Polonskiy v. Russia, no. 30033/05, §§ 160 et seq., 19 March 2009; Kart v. Turkey [GC], no. 8917/05, §§ 71 et seq., 3 December 2009; see also, in the context of civil proceedings, Mihajlović v. Croatia, no. 21752/02, §§ 26 et seq., 7 July 2005). - EGMR, 03.07.2014 - 37966/07
ANTAYEV AND OTHERS v. RUSSIA
However, having regard to its conclusion above under Article 3 of the Convention, the Court considers it unnecessary to examine those issues separately under Article 13 of the Convention (see, for example, Bekos and Koutropoulos v. Greece, no. 15250/02, § 57, ECHR 2005-XIII (extracts); Polonskiy v. Russia, no. 30033/05, § 127, 19 March 2009; and Sherstobitov v. Russia, no. 16266/03, § 94, 10 June 2010).
- EGMR, 20.06.2013 - 73455/11
SIDIKOVY v. RUSSIA
Therefore, the Court will assess this period of detention in its entirety (see, mutatis mutandis, Polonskiy v. Russia, no. 30033/05, § 132, 19 March 2009; Gubkin v. Russia, no. 36941/02, § 134, 23 April 2009; and Solmaz v. Turkey, no. 27561/02, §§ 34-37, 16 January 2007, in the context of Article 5 § 3 of the Convention).
- EGMR, 21.04.2011 - 42310/04
[ENG]
Bearing that in mind, and given the authorities' failure to challenge, or even to explain, the medical evidence in support of the applicant's allegation of ill-treatment by electric current, the Court finds it established to the standard of proof required in Convention proceedings that the injuries recorded in the medical reports were the result of the treatment of which the applicant complained and for which the Government bore responsibility (see Polonskiy v. Russia, no. 30033/05, § 123, 19 March 2009, and cited therein Mehmet Emin Yüksel v. Turkey, no. 40154/98, § 30, 20 July 2004). - EGMR, 23.10.2014 - 17239/13
MAMAZHONOV v. RUSSIA
In the Court's view, the delayed commencement of the inquiry resulted in a loss of precious time, which had a negative impact on the success of the investigation (see, mutatis mutandis, Mikheyev v. Russia, no. 77617/01, § 114, 26 January 2006; Polonskiy v. Russia, no. 30033/05, § 111, 19 March 2009; and Dobriyeva and Others v. Russia, no. 18407/10, § 74, 19 December 2013). - EGMR, 19.11.2019 - 75734/12
RAZVOZZHAYEV v. RUSSIA AND UKRAINE
They referred to the judgment in the case of Polonskiy v. Russia (no. 30033/05, 19 March 2009), where the complaint had been declared inadmissible because the applicant had not complained about the relevant act of impounding his car. - EGMR, 30.07.2009 - 20571/04
LAMAZHYK v. RUSSIA
Indeed, the Supreme Court had to assess the necessity of further extensions in the light of the entire preceding period of detention, taking into account how much time had already been spent in custody (see, for similar reasoning, Lyubimenko v. Russia, no. 6270/06, § 62, 19 March 2009 and Polonskiy v. Russia, no. 30033/05, § 132, 19 March 2009). - EGMR, 24.03.2016 - 51445/09
ZHEREBIN v. RUSSIA
The risks must be assessed with reference to a number of other relevant factors which may either confirm their existence or make them appear so slight that they cannot justify detention pending trial (compare Polonskiy v. Russia, no. 30033/05, § 147, 19 March 2009). - EGMR, 19.02.2019 - 44436/09
BEKETOV v. UKRAINE
Having regard to its conclusion in paragraph 102 above, the Court considers it unnecessary to examine those issues separately under Article 13 of the Convention (see Polonskiy v. Russia, no. 30033/05, § 127, 19 March 2009). - EGMR, 24.04.2012 - 41794/04
