  • EGMR, 08.02.2011 - 36988/07

    [ENG]

As for the danger that the accused may hinder the proper conduct of the proceedings, it is not a ground of detention which can be relied upon in abstracto, it has to be supported by factual evidence (Trzaska v. Poland, no. 25792/94, § 65, 11 July 2000).

The Court reiterates that in the case of a person whose detention falls within the ambit of Article 5 § 1 (c), Article 5 § 4 requires that a hearing be held (see Trzaska v. Poland, no. 25792/94, § 74, 11 July 2000).

  • EGMR, 19.10.2000 - 27785/95

    WLOCH v. POLAND

    Auszug aus EGMR, 11.10.2005 - 37444/97
The prosecutor's submissions were put on the record of the session (see also Włoch v. Poland, no. 27785/95, judgment of 19 October 2000, §§ 69-73).

In that regard, it would in particular refer to its judgments in the cases of Niedbała v. Poland (cited above §§ 48-57) and Włoch v. Poland (no. 27785/95, §§ 125-132; 19 October 2000, ECHR-2000-XI, p. 35-36; §§ 125-131), in which it has repeated the criteria established in its case-law in respect of the "fundamental guarantees of procedure applied in matters of deprivation of liberty" and has emphasised that one of the essential features of such a procedure is equality of arms between the prosecutor and the detained person.

    X. c. THE UNITED KINGDOM

    Auszug aus EGMR, 11.10.2005 - 37444/97
Such restrictions as limitations put on the number of family visits, supervision over those visits and, if so justified by the nature of the offence, subjection of a detainee to a special prison regime or special visit arrangements constitute an interference with his rights under Article 8 but are not, by themselves, in breach of that provision (ibid. §§ 62-63; see also X v. the United Kingdom, no. 8065/77, Commission decision of 3 May 1978, Decisions and Reports 14, p. 246).

Ableitung einer allgemeinen Verpflichtung zur Entlassung eines …

    Auszug aus EGMR, 11.10.2005 - 37444/97
Continued detention can be justified in a given case only if there are specific indications of a genuine requirement of public interest which, notwithstanding the presumption of innocence, outweighs the rule of respect for individual liberty laid down in Article 5 of the Convention (see, among other authorities, Kudła v. Poland [GC], no. 30210/96, §§ 110-111 with further references, ECHR 2000-XI).

    NIEDBALA v. POLAND

    Auszug aus EGMR, 11.10.2005 - 37444/97
The Court recalls that in a number of its previous judgments - for instance, those in the cases of Niedbała v. Poland (no 27915/95, judgment of 4 July 2000, §§ 48-57) and of Dacewicz v. Poland (no. 34611/97, judgment of 2 July 2002, § 21 et seq.) - it has already dealt with the question whether under the Polish legislation in force at the material time a prosecutor could be regarded as a "judicial officer" endowed with attributes of "independence" and "impartiality" required under Article 5 § 3.

Accordingly, the time-limit for submitting the related complaint to the Court expired six months after 4 May 1999 (see G.K. v. Poland (dec.), no. 38816/97, 8 December 1998; Baginski v. Poland (dec.), no. 37444/97, 21 January 2003; Oratowski v. Poland, (dec.), no. 40698/98, 6 February 2003; Al Akidi v. Bulgaria (dec.), no. 35825/97, 19 September 2000; and Hristov v. Expectation of a heavy sentence and weight of evidence may be relevant but are not as such decisive and the possibility of obtaining guarantees may have to be used to offset any risk (see Baginski v. Poland, no. 37444/97, § 72, 11 October 2005).

  • EGMR, 19.10.2000 - 27785/95

    WLOCH v. POLAND

    Auszug aus EGMR, 21.01.2003 - 37444/97
The prosecutor's submissions were put on the record of the session (see also Włoch v. Poland, no. 27785/95, judgment of 19 October 2000, §§ 69-73).

The Court, having regard to the criteria established in its case-law in respect of the procedural requirements of Article 5 § 4 and, more particularly, to its judgments in the cases of Niedbała v. Poland (no. 27915/95, §§ 48-57, 4 July 2000) and Włoch v. Poland (no. 27785/95, §§ 125-132; 19 October 2000, ECHR-2000-X), considers that an examination of the merits of the complaint is required.

  • EGMR, 04.07.2000 - 27915/95

    NIEDBALA v. POLAND

    Auszug aus EGMR, 21.01.2003 - 37444/97
The Court, having regard to the criteria established in its case-law in respect of a "judge" or "officer authorised by law to exercise judicial power" for the purposes of Article 5 § 3 and, more particularly, to its judgment in the case of Niedbała v. Poland, (no. 27915/95, §§ 48-57, 4 July 2000, unreported), considers that an examination of the merits of the complaint is required.

Ableitung einer allgemeinen Verpflichtung zur Entlassung eines …

    Auszug aus EGMR, 21.01.2003 - 37444/97
The Court will assess the reasonableness of the length of the impugned proceedings in the light of the particular circumstances of the case and having regard to the criteria laid down in its case-law, in particular the complexity of the case and the conduct of the applicant and of the relevant authorities (see, among many other authorities, Kudła v. Poland [GC], no. 30210/96, § 124, ECHR-2000-X).
  • EGMR, 20.11.2013 - 31583/96

KLAMECKI ET 57 AUTRES AFFAIRES CONTRE LA POLOGNE

    Auszug aus EGMR, 21.01.2003 - 37444/97
The Court has already dealt with a number of similar cases against Poland that arose out of the fact that under domestic criminal legislation applicable at the material time there was no possibility for a person detained at the investigative stage to be brought before anyone other than a prosecutor (see, among many other examples, G.K. v. Poland (dec.), no. 38816/97, 8 December 1998, unreported).
