It follows, among other things, that a judgment in which the Court finds a breach imposes on the respondent State, inter alia, to choose, subject to supervision by the Committee of Ministers, the general and/or, if appropriate, individual measures to be adopted in their domestic legal order to put an end to the violation found by the Court and to redress so far as possible the effects (see, by analogy, Scozzari and Giunta v. Italy [GC], nos. 39221/98 and 41963/98, § 249, ECHR 2000-VIII).

Nach der Entscheidung RGSt 40, 321 soll dieser, wie in ähnlichen Vorschriften des StGB, nur vorliegen, wenn der Tod durch vollendeten Brand verursacht wird, nicht schon bei nur versuchter Brandstiftung.Der Entscheidung RGSt 40, 321 ist nicht beizutreten.
Entsprechend hat das Reichsgericht beim versuchten Raube entschieden, der straferhöhende Umstand der Todesfolge habe für den Versuch dieselbe Bedeutung wie für die vollendete Tat, allerdings im Hinblick auf die Entscheidung RGSt 40, 321 mit dem Zusatz, die Vorschrift des § 309 StGB sei anders gestaltet (RGSt 62, 422).
