LABITA c. ITALIE
Auszug aus EGMR, 16.06.2005 - 62208/00
It prohibits in absolute terms torture or inhuman or degrading treatment or punishment, irrespective of the circumstances and the victim's behaviour (see Labita v. Italy [GC], no. 26772/95, § 119, ECHR 2000-IV). - EGMR, 19.04.2001 - 28524/95
PEERS v. GREECE
Auszug aus EGMR, 16.06.2005 - 62208/00
In this connection the Court recalls that in the Peers case even a much bigger cell - namely that of 7 m² for two inmates - was noted as a relevant aspect for finding a violation of Article 3, albeit in that case the space factor was coupled with the established lack of ventilation and lighting (see Peers v. Greece, no. 28524/95, §§ 70-72, ECHR 2001-III). - EGMR, 24.07.2001 - 44558/98
VALASINAS v. LITHUANIA
Auszug aus EGMR, 16.06.2005 - 62208/00
The assessment of this minimum level of severity is relative; it depends on all the circumstances of the case, such as the duration of the treatment, its physical and mental effects and, in some cases, the sex, age and state of health of the victim (see Valašinas v. Lithuania, no. 44558/98, §§ 100-101, ECHR 2001-VIII). - EGMR, 06.03.2001 - 40907/98
Griechenland, Ausweisung, Abschiebung, Abschiebungshaft, Haftbedingungen, …
Auszug aus EGMR, 16.06.2005 - 62208/00
When assessing conditions of detention, one must consider their cumulative effects as well as the applicant's specific allegations (see Dougoz v. Greece, no. 40907/98, § 46, ECHR 2001-II). - EGMR, 07.06.2007 - 30138/02
NURMAGOMEDOV v. RUSSIA
Auszug aus EGMR, 16.06.2005 - 62208/00
By contrast, in some other cases no violation of Article 3 was found, as the restricted space in the sleeping facilities was compensated by the freedom of movement enjoyed by the detainees during the day-time (see Valašinas, cited above, §§ 103, 107; Nurmagomedov v. Russia (dec.), no. 30138/02, 16 September 2004).

TESTA v. CROATIA
m of personal space during his 35-day period of detention (see Labzov v. Russia, no. 62208/00, §§ 41-49, 16 June 2005), and in the Mayzit case, where the applicant was afforded less than 2 sq. - EGMR, 01.03.2007 - 72967/01
BELEVITSKIY v. RUSSIA
The Court has frequently found a violation of Article 3 of the Convention on account of the lack of personal space afforded to detainees (see, in particular, Mamedova, cited above, § 62 et seq.; Khudoyorov v. Russia, no. 6847/02, § 104 et seq., 8 November 2005; Labzov v. Russia, no. 62208/00, § 44 et seq., 16 June 2005; Novoselov v. Russia, no. 66460/01, § 41 et seq., 2 June 2005; Mayzit v. Russia, no. 63378/00, § 39 et seq., 20 January 2005; and Kalashnikov v. Russia, no. 47095/99, §§ 97 et seq., ECHR 2002-VI).The Court has examined the validity of the reservation and found it compatible with the requirements of Article 57 of the Convention (see Labzov v. Russia (dec.), no. 62208/00, 28 February 2002).
- EGMR, 17.12.2009 - 20075/03
SHILBERGS v. RUSSIA
However, the Court cannot overlook the fact that the amount of RUB 1, 500 awarded for more than three months of detention, that is, a rate of RUB 14.5 per day, was substantially lower than what it generally awards in comparable Russian cases (see, for example, Labzov v. Russia, no. 62208/00, 16 June 2005, and Kantyrev v. Russia, no. 37213/02, 21 June 2007).The Court has frequently found a violation of Article 3 of the Convention on account of a lack of personal space afforded to detainees (see Khudoyorov v. Russia, no. 6847/02, §§ 104 et seq., ECHR 2005-X (extracts); Labzov v. Russia, no. 62208/00, §§ 44 et seq., 16 June 2005; Novoselov v. Russia, no. 66460/01, §§ 41 et seq., 2 June 2005; Mayzit v. Russia, no. 63378/00, §§ 39 et seq., 20 January 2005; Kalashnikov v. Russia, no. 47095/99, §§ 97 et seq., ECHR 2002-VI; and Peers v. Greece, no. 28524/95, §§ 69 et seq., ECHR 2001-III).
- EGMR, 09.10.2008 - 62936/00
MOISEYEV v. RUSSIA
In those cases applicants usually disposed of less than three sq.m of personal space (see, for example, Lind v. Russia, no. 25664/05, § 59, 6 December 2007; Kantyrev v. Russia, no. 37213/02, §§ 50-51, 21 June 2007; Andrey Frolov v. Russia, no. 205/02, §§ 47-49, 29 March 2007; Mayzit v. Russia, no. 63378/00, § 40, 20 January 2005; and Labzov v. Russia, no. 62208/00, § 44, 16 June 2005). - EGMR, 19.06.2008 - 24650/02
GULIYEV v. RUSSIA
In this connection, the Court reiterates that in a number of cases in which detained applicants usually disposed of less than three and a half square metres of personal space it has already found that the lack of personal space afforded to them was so extreme as to justify, in its own right, a violation of Article 3 of the Convention (see Kantyrev v. Russia, no. 37213/02, §§ 50-51, 21 June 2007; Igor Ivanov v. Russia, no. 34000/02, §§ 37-38, 7 June 2007; Benediktov v. Russia, no. 106/02, §§ 36-38, 10 May 2007; Andrey Frolov v. Russia, no. 205/02, §§ 47-49, 29 March 2007; Mayzit v. Russia, no. 63378/00, §§ 40, 20 January 2005; and Labzov v. Russia, no. 62208/00, §§ 44, 16 June 2005, among others). The Court has frequently found a violation of Article 3 of the Convention on account of lack of personal space afforded to detainees (see Khudoyorov v. Russia, no. 6847/02, § 104 et seq., ECHR 2005-... (extracts); Labzov v. Russia, no. 62208/00, § 44 et seq., 16 June 2005; Novoselov v. Russia, no. 66460/01, § 41 et seq., 2 June 2005; Mayzit v. Russia, no. 63378/00, § 39 et seq., 20 January 2005; Kalashnikov v. Russia, no. 47095/99, §§ 97 et seq., ECHR 2002-VI; and Peers v. Greece, no. 28524/95, §§ 69 et seq., ECHR 2001-III).
- EGMR, 20.10.2011 - 5774/10
[ENG]
In its previous cases where applicants had at their disposal less than 3 square metres of personal space, the Court found that the overcrowding was so severe as to justify of itself a finding of a violation of Article 3 of the Convention (see, among many other authorities, Sulejmanovic v. Italy, no. 22635/03, § 51, 16 July 2009; Lind v. Russia, no. 25664/05, § 59, 6 December 2007; Kantyrev v. Russia, no. 37213/02, § 50-51, 21 June 2007; Andrey Frolov v. Russia, no. 205/02, § 47-49, 29 March 2007; and Labzov v. Russia, no. 62208/00, § 44, 16 June 2005). - EGMR, 17.06.2010 - 8217/04
[ENG]
Referring to the Court's vast case-law (the cases of Kalashnikov v. Russia, no. 47095/99, ECHR 2002-VI; Labzov v. Russia, no. 62208/00, 16 June 2005; and Khudoyorov v. Russia, no. 6847/02, ECHR 2005-X (extracts)), the applicant considered that he had no effective remedies available at the domestic level. The Court has frequently found a violation of Article 3 of the Convention on account of the lack of personal space afforded to detainees (see, among other authorities, Kalashnikov v. Russia, no. 47095/99, §§ 97 et seq., ECHR 2002-VI; Khudoyorov v. Russia, no. 6847/02, §§ 104 et seq., ECHR 2005-X; Labzov v. Russia, no. 62208/00, §§ 44 et seq., 16 June 2005; Mayzit v. Russia, no. 63378/00, §§ 39 et seq., 20 January 2005; and Novoselov v. Russia, no. 66460/01, §§ 41 et seq., 2 June 2005).

- EGMR, 29.04.2008 - 4792/03
PETREA v. ROMANIA
The Court has frequently found a violation of Article 3 of the Convention on account of the lack of personal space afforded to detainees (see, in particular, Kalashnikov, cited above, §§ 97 et seq., Labzov v. Russia, no. 62208/00, § 44 et seq.; Mayzit v. Russia, no. 63378/00, § 39 et seq., 20 January 2005; Khudoyorov v. Russia, no. 6847/02, § 104 et seq., 8 November 2005; Novoselov v. GLADKIY v. RUSSIA
To sum up, the Court has frequently found a violation of Article 3 of the Convention on account of lack of personal space afforded to detainees (see Khudoyorov v. Russia, no. 6847/02, §§ 104 et seq., ECHR 2005-... (extracts); Labzov v. Russia, no. 62208/00, §§ 44 et seq., 16 June 2005; Novoselov v. Russia, no. 66460/01, §§ 41 et seq., 2 June 2005; Mayzit v.
