    According to the Court's established case-law, the test of necessity in a democratic society requires the Court to determine whether the interference complained of corresponded to a pressing social need, whether it was proportionate to the legitimate aim pursued and whether the reasons given by the national authorities to justify it are relevant and sufficient (see The Sunday Times v. the United Kingdom (no. 1), 26 April 1979, § 62, Series A no. 30).

    Furthermore, the Court has consistently held that it is not for it, any more than it is for the national courts, to substitute its own views for those of the press as to what techniques of reporting should be adopted in a particular case (see Jersild v.     When assessing the margin of appreciation in a case such as this, as well as the proportionality of the impugned interference and the Finnish regime pursuant to which it was adopted, the Court must also assess the legislative choices which lay behind it and, in that context, the quality of the parliamentary and judicial review of the necessity of that legislation and the measures adopted on that basis which interfere with freedom of expression (see, in this regard, Animal Defenders International v. the United Kingdom [GC], no. 48876/08, §§ 108 and 110, ECHR 2013 (extracts)).

    This Court has previously attached great importance to the quality of parliamentary review of the necessity of legislation restricting rights (see Animal Defenders International v. the United Kingdom [GC], no. 48876/08, §§ 108 and 110, ECHR 2013 (extracts)).[10] In this case, the majority considers the parliamentary review conducted by the Finnish Parliament to be "exacting and pertinent" (§ 193 of the judgment).

    Provided that they are acting in good faith (see Section D below) and on an accurate factual basis in accordance with the ethics of journalism, Article 10 leaves it for journalists to decide whether or not to divulge information on issues of general interest (see Fressoz and Roire v.     Where the impugned information was already publicly available, the Court has had regard to this factor in its assessment of whether the impugned restriction on freedom of speech was "necessary" for the purposes of Article 10 § 2. Norway, no. 34438/04, §§ 62-63, 16 April 2009; and Shabanov and Tren v. Russia, no. 5433/02, §§ 44-50, 14 December 2006).

    In the light of the above considerations and taking into account the aims of the Data Protection Convention, reflected in Directive 95/46 and, more recently, in Regulation 2016/79 (see paragraphs 59 and 67 above), it is clear that the interference with the applicant companies' right to freedom of expression pursued the legitimate aim of protecting "the reputation or rights of others", within the meaning of Article 10 § 2 of the Convention.

    That scrutiny and debate at domestic level was furthermore reflected in the data protection context at EU level, when it came to the adoption of the Data Protection Directive and, subsequently, of Regulation 2016/79.

November 1950 in Rom unterzeichneten Europäischen Konvention zum Schutz der Menschenrechte und Grundfreiheiten (im Folgenden: EMRK) gewährleisteten Rechten entsprechen, und dass der Schutz personenbezogener Daten für die Ausübung des in Art. 8 EMRK verankerten Rechts auf Achtung des Privat- und Familienlebens eine grundlegende Rolle spielt (EGMR, Urteil vom 27. Juni 2017, Satakunnan Markkinapörssi Oy und Satamedia Oy/Finnland, CE:ECHR:2017:0627JUD000093113, § 137).

    Rn. 60 Aus der Rechtsprechung des Europäischen Gerichtshofs für Menschenrechte ergibt sich, dass für die Zwecke der Abwägung zwischen dem Recht auf Achtung des Privatlebens und dem Recht auf freie Meinungsäußerung und Information eine Reihe relevanter Kriterien zu berücksichtigen sind, wie der Beitrag zu einer Debatte von allgemeinem Interesse, der Bekanntheitsgrad der betroffenen Person, der Gegenstand der Berichterstattung, das vorangegangene Verhalten der betroffenen Person, Inhalt, Form und Auswirkungen der Veröffentlichung, die Art und Weise sowie die Umstände, unter denen die Informationen erlangt worden sind, und deren Richtigkeit (vgl. in diesem Sinne EGMR, Urteil vom 27. Juni 2017, Satakunnan Markkinapörssi Oy und Satamedia Oy/Finnland, CE:ECHR:2017:0627JUD000093113, § 165).
