Abschiebungshaft, Malta, Rechtsweggarantie, effektiver Rechtsschutz, …

    Auszug aus EGMR, 23.07.2013 - 55352/12
Most of the domestic remedies available to challenge the lawfulness of detention (Article 409A of the Criminal Code - Chapter 9 of the Laws of Malta; Article 25A (9) of the Immigration Act - Chapter 217 of the Laws of Malta; and a constitutional application) had already been declared by the Court to be ineffective and insufficient for the purposes of Article 5 § 4 in the case of Louled Massoud v. Malta (no. 24340/08, §§ 43-46, 27 July 2010).

The notion of "lawfulness" under Article 5 § 4 of the Convention has the same meaning as in Article 5 § 1, so that the arrested or detained person is entitled to a review of the "lawfulness" of his detention in the light not only of the requirements of domestic law, but also of the Convention, the general principles embodied therein and the aim of the restrictions permitted by Article 5 § 1 (see E. v. Norway, 29 August 1990, § 50, Series A no. 181, and Louled Massoud v. Malta, no. 24340/08, § 39, 27 July 2010; and Rahmani and Dineva v. Bulgaria, no. 20116/08, § 75, 10 May 2012).

Moreover, the dormitories were equipped with separate lavatories allowing for a degree of privacy (see, by contrast, Peers v. Greece, no. 28524/95, § 73, ECHR 2001-III).
  • EGMR, 14.03.2017 - 47287/15

Ungarn wegen Inhaftierung von Flüchtlingen verurteilt

While it is true that asylum seekers are considered particularly vulnerable because of everything they might have been through during their migration and the traumatic experiences they were likely to have endured previously (see M.S.S. v. Belgium and Greece, cited above, § 232), for the Court, the applicants in the present case were not more vulnerable than any other adult asylum-seeker detained at the time (see, Mahamed Jama v. Malta, no. 10290/13, § 100, 26 November 2015, and, a contrario, Aden Ahmed v. Malta, no. 55352/12, §§ 97-99, 23 July 2013).
  • EGMR, 07.07.2015 - 28005/12

M.N. AND OTHERS v. SAN MARINO

The Court considers that the Government should normally be able to illustrate the practical effectiveness of a remedy with examples of domestic case-law, but it is ready to accept that this may be more difficult in smaller jurisdictions, such as in the present case, where the number of cases of a specific kind may be fewer than in the larger jurisdictions (see Aden Ahmed v. Malta, no. 55352/12, § 63, 23 July 2013).
  • VG Oldenburg, 23.07.2014 - 12 B 1217/14

    L.Z. AND D.Z. v. ITALY

Rn. 170 Les principes généraux pertinents en l'espèce ont été résumés dans les arrêts Suso Musa c. Malte, no 42337/12, § 120, 23 juillet 2013, Micha et autres c. Grèce, no 13991/20, §§ 62-65, 8 octobre 2024, et Ilgar Mammadov c. Azerbaïdjan (recours en manquement) [GC], no 15172/13, § 182, 29 mai 2019.
  • EGMR, 03.05.2016 - 56796/13

    ABDI MAHAMUD v. MALTA

Further relevant domestic law concerning the case is to be found in Suso Musa v. Malta (no. 42337/12, §§ 23-32, 23 July 2013).

Despite the Court's findings in the cases of Suso Musa v. Malta (no. 42337/12, §§ 58-59) and Aden Ahmed (cited above, §§ 121-22) that, even assuming that such a remedy applied in the applicant's case, it was also not effective, the Government failed to explain why such a remedy was still available to the applicant despite such limitation and the circumstances as appeared at the time.

She relied on the case of Suso Musa v. Malta (no. 42337/12, 23 July 2013).

  • EGMR, 12.01.2016 - 52160/13

MOXAMED ISMAACIIL v. MALTA and 1 other application

The relevant domestic law concerning the case is to be found in Suso Musa v. Malta (no. 42337/12, §§ 23-32, 23 July 2013) and Aden Ahmed v. Malta (no. 55352/12, §§ 31-39, 23 July 2013).

The applicants complained under Article 3 in respect of the conditions of their detention in Lyster Barracks, they relied on Aden Ahmed v. Malta (no. 55352/12, 23 July 2013).

The applicants submitted that there existed no effective domestic remedy which should have been used; in fact most of the Government's arguments had already been rejected by the Court in its judgment in the case of Aden Ahmed v. Malta (no. 55352/12, 23 July 2013) concerning an immigrant detained at around the same time as the applicants in the present case.

  • EGMR, 12.01.2016 - 37537/13

    BORG v. MALTA

He referred to the cases of Suso Musa v. Malta (no. 42337/12, 23 July 2013), and Aden Ahmed v. Malta (no. 55352/12, 23 July 2013).
  • EGMR, 04.06.2026 - 368/21

    CIOTTA v. ITALY

Rn. 195 Les principes généraux pertinents en l'espèce ont été résumés dans les arrêts Suso Musa c. Malte, no 42337/12, § 120, 23 juillet 2013, Micha et autres c. Grèce, no 13991/20, §§ 62-65, 8 octobre 2024, et Ilgar Mammadov c. Azerbaïdjan (recours en manquement) [GC], no 15172/13, § 182, 29 mai 2019.
