Having regard to its case-law applicable in comparable situations, the Court finds that those two periods of the second applicant's pre-conviction detention were non-consecutive and should be assessed separately (see Idalov, cited above, §§ 129-130; Chuprikov, cited above, §§ 61-63; and Osakovskiy v. Ukraine, no. 13406/06, § 78, 17 July 2014).Consequently, the second applicant's complaints of the unlawfulness and length of the first period of his pre-conviction detention between 14 October 2005 and 25 May 2007 were lodged out of time and should be rejected in accordance with Article 35 §§ 1 and 4 of the Convention (see, mutatis mutandis, Idalov, cited above, §§ 129-130; and Osakovskiy v. Das Arbeitsgericht Wiesbaden hat mit einem am 10. Mai 2016 verkündeten Urteil - 12/10 Ca 83/11 (Bl. 430ff. d.A.) - die Beklagten wie Gesamtschuldner verurteilt, an den Kläger Euro 91.807,00 zu zahlen und die Klage im Übrigen abgewiesen.

Senatsurteile vom 23.12.2011, Az. 5 U 57/11, 5 U 76/11, 5 U 77/11, 5 U 99/11), oder ob sie eine in den angesprochenen Kreisen gezielt gesteuerte falsche Erwartungshaltung systematisch ausgenutzt hat, was der Senat vorliegend als haftungsbegründend ansieht.

Der vom Verwaltungsgericht zitierten Entscheidung des Thüringer Oberverwaltungsgerichts vom 11. September 2015 (2 KO 76/11) liege ein anderer Ausgangssachverhalt zugrunde, in der die Erteilung der Fahrerlaubnis mit der erstmaligen Ausstellung des Führerscheins zusammengefallen sei.Dem steht das Urteil des Senats vom 11. September 2015 (Az. 2 KO 76/11) nicht entgegen, weil es in dem zugrundeliegenden Fall auf eine Differenzierung zwischen den Zeitpunkten der Erteilung der Fahrerlaubnis und der Ausstellung des Führerscheins nicht ankam.
