Furthermore, the Court reiterates that it cannot be its task to deal with a succession of ill-founded and querulous complaints or with otherwise manifestly abusive conduct of applicants or their authorised representatives, which creates gratuitous work for the Court, incompatible with its real functions under the Convention (see Petrovic v. Serbia (dec.), no. 56551/11, 18 October 2011; and The Georgian Labour Party v. Georgia (dec.), no. 9103/04, 22 May 2007). - EGMR, 02.05.2006 - 5667/02
KÉRÉTCHACHVILI c. GEORGIE

It recalls that an application may be rejected as abusive under Article 35 § 3 of the Convention if, among other reasons, it was knowingly based on untrue facts (see Keretchashvili v. Georgia (dec.), no. 5667/02, 2 May 2006; and Rehak v. Czech Republic (dec.), no. 67208/01, 18 May 2004).

Incomplete and therefore misleading information may also amount to an abuse of the right of application, especially if the information concerns the very core of the case and no sufficient explanation is given for the failure to disclose that information (see Pirtskhalaishvili v. CASALI v. SAN MARINO and 1 other application
Rn. 84 The Court reiterates that dealing with manifestly abusive conduct by applicants or their authorised representatives is incompatible with its proper functions under the Convention (see Bekauri v. Georgia (preliminary objection), no. 14102/02, § 21, 10 April 2012, and De Cristofaro v. Italy (dec.), nos. - EGMR, 12.05.2015 - 36862/05
[FRE]
The Court reiterates that an application may be rejected as abusive under Article 35 § 3 of the Convention if it was knowingly based on untrue facts (see, among other authorities, Akdivar and Others v. Turkey, 16 September 1996, §§ 53-54, Reports of Judgments and Decisions 1996-IV, and Keretchashvili v. Georgia (dec.), no. 5667/02, 2 May 2006) or if incomplete and therefore misleading information was submitted to the Court (see Bekauri v. Georgia (preliminary objection), no. 14102/02, §§ 21 and 24, 10 April 2012, and Hüttner v. Germany (dec.), no. 23130/04, 9 June 2006). - EGMR, 30.09.2014 - 67810/10
GROSS c. SUISSE
In a previous case the Court found that counsel's negligent lack of awareness of the commutation of their client's life sentence and their failure to inform the Court once they learned of this fact constituted abuse of the right of individual petition (see Bekauri v. Georgia (preliminary objection), no. 14102/02, §§ 23-25, 10 April 2012).
- EGMR, 01.10.2026 - 15548/23 The Court reiterates that lawyers must understand that, having due regard to the Court's duty to examine allegations of human rights violations, they must show a high level of professional prudence and meaningful cooperation with the Court by sparing it from the introduction of unmeritorious complaints and, once proceedings have been instituted, then meticulously abide by all the relevant rules of procedure and urge their clients to do the same (see Bekauri v. Georgia (preliminary objection), no. 14102/02, § 24, 10 April 2012).
- EGMR, 13.04.2017 - 66357/14
PODESCHI v. SAN MARINO
Similarly, an application can be rejected as abusive if applicants - despite their obligation under Article 47 of the Rules of Court - fail to inform the Court about new, important developments regarding their pending applications given that such conduct prevents the Court from ruling on the matter in full knowledge of the facts (see Bekauri v. Georgia (dec.), no. 14102/02, §§ 21-23, 10 April 2012). - EGMR, 16.07.2019 - 12200/08
[ENG]
For example, the Court found that an applicant's conduct had been contrary to the purpose of the right of individual petition in cases where the applicant had lodged a succession of ill-founded and querulous complaints, creating unnecessary work which was incompatible with the Court's real functions, and which hindered it in carrying them out (see M. v. the United Kingdom, no. 13284/87, Commission decision of 15 October 1987, Decisions and Reports (DR) 54, p. 214; Philis v. Grece, no. 28970/95, Commission decision of 17 October 1996, Decisions and Reports (DR) 54, p. 214; and Petrović, cited above); where the applicant had obtained evidence in support of his case before the Court by force in blatant violation of the rights and the values protected by the Convention (see Koch v. Poland (dec.), no. 15005/11, 7 March 2017); or where the applicant had not meticulously abided by all the relevant rules of the procedure and thereby had failed to show a high level of prudence and meaningful cooperation with the Court (see, for example, Bekauri v. Georgia (preliminary objection), no. 14102/02, §§ 22-24, 10 April 2012, and Eskerkhanov and Others v. Russia, nos. - EGMR, 29.08.2024 - 24622/22
PASQUINELLI AND OTHERS v.
14102/02, §§ 21-23, 10 April 2012, and, a contrario, Peňaranda Soto v. Malta, no. 16680/14, § 35, 19 December 2017). - EGMR, 10.01.2017 - 67618/09
STEVANCEVIC v. BOSNIA AND HERZEGOVINA
Otherwise, the willful or negligent misuse of the Court's resources may undermine the credibility of lawyers' work in the eyes of the Court and even, if it occurs systematically, may result in particular individual lawyers being banned from representing applicants under Rule 36 § 4 (b) of the Rules of Court (see also Petrović, cited above; Bekauri v. Georgia (preliminary objection), no. 14102/02, § 24, 10 April 2012; and Buzinger v. Slovakia (dec.), no. 32133/10, § 24, 16 June 2015). - EGMR, 16.05.2023 - 2394/22
FERRARA AND OTHERS v. ITALY
Having examined the circumstances of the cases at hand, the Court finds that the fragmentation of enforcement proceedings by requesting the delivery of separate assignment orders cannot be seen as an efficient enforcement of the "Pinto" decisions and judgments and was not justified by the need to protect the interests of the applicants' clients or any of the rights set forth in the Convention or the Protocols thereto (see Andrejeva, cited above, § 99, and Miholapa, cited above, § 24; compare, mutatis mutandis, Petrović, cited above; Bekauri v. Georgia, (dec.) no. 14102/02, § 21, 10 April 2012; and De Cristofaro v. Italy (dec.), nos. - EGMR, 07.06.2018 - 510/07
PREOBRAZOVATEL-SERVIS AND OTHERS v. UKRAINE
The Court reiterates that an application may be rejected as abusive under Article 35 § 3 of the Convention if it was knowingly based on untrue facts (see, among other authorities, Akdivar and Others v. Turkey, 16 September 1996, §§ 53-54, Reports of Judgments and Decisions 1996 IV, and Keretchashvili v. 23130/04, 19 June 2006). - EGMR, 01.03.2022 - 6232/20

Chypre [GC], no 21906/04, § 97, 12 février 2008 ; Nivette c. France (déc.), no 44190/98, CEDH 2001-VII ; Einhorn c. France (déc.), no 71555/01, CEDH 2001-XI ; Stanford c. Royaume-Uni (déc.), no 73299/01, 12 décembre 2002 ; Wynne c. Royaume-Uni (déc.), no 67385/01, 22 mai 2003 ; Hussain c. Royaume-Uni [GC], no 3455/05, § 128, 19 février 2009 ; Hill c. Royaume-Uni (déc.), no 19365/02, 18 mars 2003 ; Scoppola c. Italie (déc.), no 10249/03, 10 septembre 2005 ; Garagin c.
