  • EGMR, 21.02.1975 - 4451/70
    Auszug aus EGMR, 03.12.2002 - 48221/99
The Court reiterates that the "right to a court", of which the right of access is one aspect (see, in particular, Golder v. the United Kingdom, judgment of 21 February 1975, Series A no. 18, p. 18, § 36), is not absolute; it is subject to limitations permitted by implication, in particular where the conditions of admissibility of an appeal are concerned, since by its very nature it calls for regulation by the State, which enjoys a certain margin of appreciation in this regard (see Levages Prestations Services v. France, judgment of 23 October 1996, Reports of Judgments and Decisions 1996-V, p. 1543, § 40).
  • EGMR, 13.07.1995 - 18139/91

TOLSTOY MILOSLAVSKY v. THE UNITED KINGDOM

    Auszug aus EGMR, 03.12.2002 - 48221/99
However, these limitations must not restrict or reduce a person's access in such a way or to such an extent that the very essence of the right is impaired; lastly, such limitations will not be compatible with Article 6 § 1 if they do not pursue a legitimate aim or if there is not a reasonable relationship of proportionality between the means employed and the aim sought to be achieved (see, among other authorities, Tolstoy Miloslavsky v. the United Kingdom, judgment of 13 July 1995, Series A no. 316-B, pp. 78-79, § 59, and Bellet v. France, judgment of 4 December 1995, Series A no. 333-B, p. 41, § 31).

    BELLET c. FRANCE

333-B, p. 41, § 31).
  • EGMR, 13.09.2001 - 48991/99

    BENNOUR contre la FRANCE

    Auszug aus EGMR, 03.12.2002 - 48221/99
Thus, although it declared the appeal inadmissible, the Court of Cassation did nonetheless examine it in order to ensure that the decision appealed against had been properly reached (see, mutatis mutandis, Bennour v. France (dec.), no. 48991/99, 13 September 2001).
  • EGMR, 02.10.2014 - 15319/09

    [ENG]

More generally, it is established case-law that the manner of regulation of the right to access to a court, including access to a court of appeal, is a matter in respect of which the Contracting States enjoy a certain margin of appreciation (see Berger v. France, no. 48221/99, § 30, ECHR 2002-X (extracts), with further references).
  • EGMR, 26.07.2011 - 54932/08

    [FRE]

Grèce, no 44035/05, § 21, 22 mai 2008 et Berger c. France, no 48221/99, § 35, 3 décembre 2002, CEDH 2002-X, extraits).
  • EGMR, 14.06.2005 - 39553/02

    MENET c. FRANCE

  • EGMR, 15.11.2022 - 48512/20

    DAHMAN BENDHIMAN v. SPAIN

The first issue to be addressed is whether the procedure to be followed for an appeal could be regarded as foreseeable from the point of view of a litigant and whether, accordingly, the consequences he bore for failing to follow that procedure did not infringe the proportionality principle (see Berger v. France, no. 48221/99, § 32, ECHR 2002-X (extracts), with further references).
  • EGMR, 02.09.2014 - 19312/07

    TCHAGHIASHVILI v. GEORGIA

However, the Court, in the light of its extensive similar case-law on the matter, considers that the mere fact that the applicant's appeal on points of law was declared inadmissible on the ground that it lacked significant pecuniary and/or legal interest cannot be considered, in a situation where he had had the benefit of fully adversarial proceedings on the merits before the first instance and appellate courts, either as an unreasonable limitation of the right to have access to court or, more generally, as a lack of due process under Article 6 § 1 of the Convention (compare, for instance, with Nersesyan v. Armenia (dec.), no. 15371/07, §§ 21-25, 19 January 2010; Venema and Others v. the Netherlands (dec.), no. 35731/97, 29 January 2002; and also Berger v. France, no. 48221/99, § 30-39, ECHR 2002-X (extracts)).
  • EGMR, 14.01.2010 - 3142/08

    [FRE]

Grèce, no 44035/05, § 21, 22 mai 2008 et Berger c. France, no 48221/99, § 35, 3 décembre 2002, CEDH 2002-X, extraits).
  • EGMR, 30.05.2006 - 59423/00

    SARL ABORCAS c. FRANCE

Espagne, no 38695/97, § 36, CEDH 2000-II ; Mortier c. France, no 42195/98, § 33, 31 juillet 2001 ; Berger c. France, no 48221/99, § 30, CEDH 2002-X).
  • EGMR, 12.03.2013 - 42927/10

    DILDIRIM AND OTHERS v. TURKEY

In this respect, any limitation or restriction is considered to be compatible with Article 6, provided that it does not impair the very essence of the right concerned and pursues a legitimate aim while respecting the relationship of proportionality between the means employed and the aim sought to be achieved (see Ashingdane v. the United Kingdom, 28 May 1985, § 57, Series A no. 93, and Berger v. France, no. 48221/99, § 30, ECHR 2002-X).
  • EGMR, 29.10.2009 - 26307/07

    STAVRINOUDAKIS c. GRECE

France, no 48221/99, § 35, 3 décembre 2002, CEDH 2002-X, extraits et Tsilira c. Grèce, no 44035/05, § 21, 22 mai 2008).
  • EGMR, 22.05.2008 - 44035/05

    TSILIRA c. GRECE

France, no 48221/99, § 35, 3 décembre 2002, CEDH 2002-X, extraits).
