Urteil Delcourt, Série A Nr. 11, S. 15, Ziff. 26, EGMR-E 1, 101 f., und Urteil Pakelli vom 25. April 1983, Série A Nr. 64, S. 14, Ziff. 29, EGMR-E 2, 278).

Februar 1984, Série A Nr. 74, S. 13, Ziff. Dezember 1983, Série A Nr. 72, S. 12 f., Ziff. 28, EGMR-E 2, 326 f. und Urteil Sutter, Série A Nr. 74, S. 13, Ziff. 30, EGMR-E 2, 350).
- EGMR, 13.06.1979 - 6833/74

Urteil vom 23. Juli 1968 im "Belgischen Sprachenfall", Série A Nr. 6, S. 34, Ziff. 10, EGMR-E 1, 38 und Urteil Marckx vom 13. Juni 1979, Série A Nr. 31, S. 15 f., Ziff.

Juni 1968, Série A Nr. 7 S. 12, Ziff. 15, EGMR-E 1, 59, und Série B Nr. 5, S. 232 und 268). - EGMR, 08.12.1983 - 8273/78

Dezember 1983, Série A Nr. 72, S. 12 f., Ziff. 28, EGMR-E 2, 326 f. und Urteil Sutter, Série A Nr. 74, S. 13, Ziff. 30, EGMR-E 2, 350). - EGMR, 02.03.1987 - 9787/82

Oktober 1986, Série A Nr. 107, S. 19, Ziff. 51, EGMR-E 3, 286). - EKMR, 20.01.1984 - 9818/82

EGMR, Monnell and Morris v. United Kingdom, Urteil vom 2. EGMR, Bulut v. Austria, Urteil vom 22. Februar 1996, Nr. 17358/90, § 42;… Rippe v. Germany, Entscheidung vom 2. Februar 2006, Nr. 5398/03, juris, Rn. 52). - EGMR, 26.05.1988 - 10563/83
EKBATANI v. SWEDEN
Criminal proceedings form an entity and the protection afforded by Article 6 (art. 6) does not cease with the decision at first instance; indeed, according to the Court's consistent case-law a State which institutes courts of appeal or cassation "is required to ensure that persons amenable to the law shall enjoy before these courts the fundamental guarantees contained in [this] Article" (art. 6) (as the most recent authority, see the Monnell and Morris judgment of 2 March 1987, Series A no. 115, p. 21, § 54).14-15, §§ 27 and 29; see also the above-mentioned Monnell and Morris judgment, Series A no. 115, p. 22, § 58).
The manner of application of Article 6 (art. 6) to proceedings before courts of appeal does, however, depend on the special features of the proceedings involved; account must be taken of the entirety of the proceedings in the domestic legal order and of the role of the appellate court therein (see, as the most recent authority, the above-mentioned Monnell and Morris judgment, Series A no. 115, p. 22, § 56).
In deciding this question, the Court must have regard to the nature of the Swedish appeal system, the scope of the Court of Appeal's powers and the manner in which the applicant's interests were actually presented and protected before the Court of Appeal (see, mutatis mutandis, the above-mentioned Monnell and Morris judgment, Series A no. 115, p. 22, § 56).
However, the Court would recall that this principle is "only one feature of the wider concept of a fair trial in criminal proceedings" (see, inter alia, the above-mentioned Monnell and Morris judgment, Series A no. 115, p. 94, § 62).
Thus, leave-to-appeal proceedings and proceedings involving only questions of law, as opposed to questions of fact, may comply with the requirements of Article 6 (art. 6), although the appellant was not given an opportunity of being heard in person by the appeal or cassation court (see, inter alia, the above-mentioned Monnell and Morris judgment, Series A no. 115, p. 22, § 58 (leave to appeal) and the Sutter judgment of 22 February 1984, Series A no. 74, p. 13, § 30 (court of cassation)).
- EGMR, 11.07.2017 - 19867/12
FONTES MOREIRA FERREIRA c. PORTUGAL
By the same token, the Court has held that the safeguards of Article 6 are applicable to criminal proceedings in which the competent court began by examining the admissibility of an application for leave to appeal with a view to having a conviction quashed (see Monnell and Morris v. the United Kingdom, 2 March 1987, § 54, Series A no. 115).Finally, the reading given (in paragraph 64 of the judgment) to the cases of Meftah and Others v. France (ï›GCï, nos. 32911/96, 35237/97 and 34595/97, ECHR 2002-VII, § 40) and Morrell and Morris v. the United Kingdom (2 March 1987, Series A no. 115, § 54) is rather strained.

KHALFAOUI c. FRANCE
The Court observes that the aim cited by the Government in justification of the existence of such an obligation was not the - in principle legitimate - one of discouraging abusive appeals to the Court of Cassation to enable that court to deal with meritorious appeals within a reasonable time (see, mutatis mutandis, the Monnell and Morris v. the United Kingdom judgment of 2 March 1987, Series A no. 115, p. 19, § 46, and p. 23, § 59).Reference is made, in the judgment of the majority, to the decision of the Court in the case of Monnell and Morris v. the United Kingdom of 2 March 1987 (Series A no. 115), in order to distinguish the procedure in that case, which was found to be fair and compatible with Article 6 of the Convention, from the procedure at issue in the present case.
- EGMR, 05.10.2006 - 45106/04
MARCELLO VIOLA c. ITALIE
The manner of application of Article 6 to proceedings before courts of appeal does, however, depend on the special features of the proceedings involved; account must be taken of the entirety of the proceedings in the domestic legal order and of the role of the appellate court therein (see Ekbatani v. Sweden, 26 May 1988, § 27, Series A no. 134, and Monnell and Morris v. the United Kingdom, 2 March 1987, § 56, Series A no. 115). - EGMR, 02.10.2014 - 15319/09
[ENG]
However, the prevailing approach seems to be that Article 6 § 1 is applicable also to leave-to-appeal proceedings (ibid., §§ 69-71; Monnell and Morris v. the United Kingdom, 2 March 1987, § 54, Series A no. 115; and Martinie v. France [GC], no. 58675/00, §§ 11 and 53-55, ECHR 2006-VI), and that the manner of its application depends on the special features of the proceedings involved, account being taken of the entirety of the proceedings conducted in the domestic legal order and of the role of the appellate or cassation court therein (Monnell and Morris, cited above, § 56).Mechanisms serving as a deterrent against such appeals pursue a legitimate aim, which has been accepted by the Court (see, for instance, Monnell and Morris v. the United Kingdom, 2 March 1987, §§ 59, 63 and 67, Series A no. 115).

MEFTAH AND OTHERS v. FRANCE
Suisse, 22 février 1984, série A no 74, p. 13, § 30, Monnell et Morris c. Royaume-Uni, 2 mars 1987, série A no 115, p. 22, § 58, Ekbatani c. Suède, 26 mai 1988, série A no 134, p. 14, § 31, Kamasinski c. Autriche, 19 décembre 1989, série A no 168, pp. 44-45, § 106, et Bulut c.
