Application no. 50806/07, lodged by Mrs Vasilica Bratu.

The rule in Article 35 § 1 is based on the assumption, reflected in Article 13 (with which it has a close affinity), that there is an effective domestic remedy available in respect of the alleged breach of an individual's Convention rights (see Selmouni v. KARNER c. AUTRICHE

    Auszug aus EGMR, 26.11.2013 - 40756/06
The Court therefore considers - without prejudice to its ruling on the question of whether the present case reveals a systemic problem of unreasonable length of proceedings or not - that respect for human rights, as defined in the Convention and the Protocol thereto, requires an examination of the application on the merits (see, mutatis mutandis, Karner v. Austria, no. 40016/98, §§ 25-28, ECHR 2003-IX, and Finger, cited above).
  • EGMR, 25.03.1999 - 25444/94
    Auszug aus EGMR, 26.11.2013 - 40756/06
The reasonableness of the length of proceedings must be assessed in the light of the circumstances of the case and with reference to the following criteria: the complexity of the case, the conduct of the applicant and the relevant authorities and what was at stake for the applicant in the dispute (see, among many other authorities, Pélissier and Sassi v. France [GC], no. 25444/94, § 67, ECHR 1999-II, and Frydlender v. France [GC], no. 30979/96, § 43, ECHR 2000-VII).

    SCOZZARI ET GIUNTA c. ITALIE

    Auszug aus EGMR, 26.11.2013 - 40756/06
Subject to monitoring by the Committee of Ministers, the respondent State remains free to choose the means by which it will discharge its legal obligation under Article 46 of the Convention, provided that such means are compatible with the conclusions set out in the Court's judgment (see Scozzari and Giunta v. Italy [GC], nos. 39221/98 and 41963/98, § 249, ECHR 2000-VIII, and Broniowski v. Poland [GC], no. 31443/96, § 192, ECHR 2004-V).

    McFarlane v. Ireland

    Auszug aus EGMR, 26.11.2013 - 40756/06
It should therefore be joined to the merits (see Sürmeli v. Germany (dec.), no. 75529/01, 29 April 2004, and McFarlane v. Ireland [GC], no. 31333/06, § 75, 10 September 2010).

Moreover, the effectiveness of a particular remedy is normally assessed with reference to the date on which the application was lodged (see, for example, Baumann v. France, no. 33592/96, § 47, ECHR 2001-V (extracts)), this rule, however, being subject to exceptions which may be justified by the specific circumstances of each case (see Nogolica v. FINGER v. BULGARIA

  • EGMR, 29.10.2015 - 73798/13

VALADA MATOS DAS NEVES c. PORTUGAL

Allemagne (déc.), no 75529/01, 29 avril 2004, McFarlane c. Irlande [GC], no 31333/06, § 75, 10 septembre 2010, Vlad et autres c. Roumanie, nos 40756/06, 41508/07 et 50806/07, § 103, 26 novembre 2013 et Panju c. Belgique, no 18393/09, § 47, 28 octobre 2014).
  • EGMR, 24.07.2018 - 53183/07

    NEGREA ET AUTRES c. ROUMANIE

Irlande [GC], no 31333/06, § 75, 10 septembre 2010, Vlad et autres c. Roumanie, nos 40756/06, 41508/07 et 50806/07, § 103, 26 novembre 2013, Panju c. Belgique, no 18393/09, § 47, 28 octobre 2014, et Valada Matos das Neves c. Portugal, no 73798/13, § 58, 29 octobre 2015).

    (Applications nos. 40756/06, 41508/07 and 50806/07).

Rn. 1 The case originated in three applications (nos. 40756/06, 41508/07 and 50806/07) against Romania lodged with the Court under Article 34 of the Convention for the Protection of Human Rights and Fundamental Freedoms ("the Convention") by three Romanian nationals, Mr Mihai Vlad, Mr Flaviu Plaţa and Mrs Vasilica Bratu ("the applicants"), on 5 October 2006, 14 September 2007 and 9 November 2007, respectively.

41508/07 and 50806/07 (Mr Plaţa and Mrs Bratu), on account of the fact that they did not have access to effective remedies in respect of their complaint under Article 6 § 1 of the Convention, and of Article 6 § 1 in respect of all applicants on account of their right to a trial within a reasonable time, and that the above violations had originated in the malfunctioning of the relevant domestic legislation and practice.
