J'ai voté pour le rejet de l'exception préliminaire du gouvernement français parce que la Commission l'avait examinée et repoussée: pour les raisons indiquées dans mon opinion séparée en l'affaire Brozicek (arrêt du 19 décembre 1989, série A no 167, pp. 23 et s.), la Cour doit selon moi laisser à la Commission le soin d'apprécier le bien-fondé de tels moyens.Je partage l'analyse et les arguments de M. le juge Martens dans son opinion séparée dans l'affaire Brozicek (arrêt du 19 décembre 1989, série A no 167, pp. 23 à 28).
