Auszug aus EGMR, 24.04.2014 - 6228/09
The general principles relating to the guarantees of a fair trial in the context of undercover investigative techniques used to combat drug trafficking and corruption are set out in the Court's extensive case-law summarised in the case of Bannikova v. Russia (no. 18757/06, §§ 33-65, 4 November 2010) and Veselov and Others (cited above, §§ 88-94).[2] See paragraphs 93 and 115 of the judgment and the previous cases of Vanyan v. Russia, no. 53203/99, §§ 46-47, 15 December 2005; Khudobin v. Russia, no. 59696/00, § 135, ECHR 2006-XII; Bannikova v. Russia, no. 18757/06, §§ 49-50, 4 November 2010; and Veselov and Others v. Russia, nos. 23200/10, 24009/07 and 556/10, §§ 106 and 126-127, 2 October 2012.

Moreover, in cases where the lack of file disclosure or the conflicting nature of the parties" interpretation of events precludes the Court from establishing with a sufficient degree of certainty whether the applicant was subjected to police incitement, the procedural aspect becomes decisive (see Edwards and Lewis v. the United Kingdom [GC], nos. 39647/98 and 40461/98, § 46, ECHR 2004-X; V. v. One example of such pre-"charge" facts is entrapment by the police: if persons have been entrapped by the police into carrying out acts that they would not otherwise carried out, any criminal proceedings brought against them on the basis of those acts will be unfair (see, among many case-law authorities, Teixeira de Castro v. Portugal, 9 June 1998, §§ 34-36, Reports of Judgments and Decisions 1998-IV; Bannikova v. Russia, no. 18757/06, §§ 33-65, 4 November 2010; and Lagutin and Others v. Russia, nos. 6228/09, 19123/09, 19678/07, 52340/08 and 7451/09, §§ 89-101, 24 April 2014). - EGMR, 20.04.2021 - 66152/14
KUZMINA v. RUSSIA and 8 other applications
It addresses the question whether the structural problem identified in Veselov and Others v. Russia (nos. 23200/10, 24009/07 and 556/10, §§ 88-94 and 126-27, 2 October 2012) and reiterated in Lagutin and Others v. Russia (nos. 6228/09, 19123/09, 19678/07, 52340/08 and 7451/09, § 134, 24 April 2014) persists.6228/09 and 4 others, §§ 62-66, 24 April 2014.
The applicants contended that their cases revealed the presence of the same underlying defect as that identified by the Court in the cases of Veselov and Others (nos. 23200/10 and 2 others, §§ 126-27, 2 October 2012), and Lagutin and Others v. Russia (nos. 6228/09 and 4 others, §§ 93, 115 and 134, 24 April 2014), in particular the absence of a clear and foreseeable procedure for authorising test purchases and operational experiments.
- EGMR, 07.10.2025 - 3023/22
HELME v. ESTONIA
Rn. 72 The Court reiterates that in cases where the main evidence originates from a covert operation, the authorities must be able to demonstrate that they had good reasons for mounting the covert operation (see Bannikova, cited above, § 40, and Lagutin and Others v. Russia, nos. 6228/09 and 4 others, § 91, 24 April 2014).It should be noted that, in this respect, the present judgment departs from established case-law, which requires the existence of "objective suspicions that the applicant had been involved in criminal activity or was predisposed to commit a criminal offence" (see Bannikova v. Russia, no. 18757/06, 4 November 2010, and Lagutin and Others v. Russia, nos. 6228/09 and 4 others, 24 April 2014).
- EGMR, 18.12.2018 - 36658/05
MURTAZALIYEVA v. RUSSIA
In a similar way, in agent provocateur cases the Court has stated that when "confronted with a plausible - and even arguable - allegation" of entrapment the courts "should have had regard to whether the results of the test purchases were admissible as evidence, in particular verifying that they were not tainted by incitement" (see Lagutin and Others v. Russia, nos. 6228/09 and 4 others, § 118, 24 April 2014). - EGMR, 23.11.2017 - 47074/12
GRBA v. CROATIA
Given that the applicant maintained throughout the proceedings that the purchase of further quantities of counterfeit euros had been a result of incitement, it was incumbent on the domestic authorities, irrespective of an explicit request by the applicant, to elucidated circumstances of the case (see, for example, Ramanauskas, cited above, § 71, and Lagutin and Others v. Russia, nos. 6228/09 and 4 others, § 121, 24 April 2014) including by way of questioning the undercover agents' superior officer, who could have dispelled any doubts as to the grounds and reasons for the multiple application of the simulated purchase model. - EGMR, 20.02.2018 - 55146/14
RAMANAUSKAS v. LITHUANIA
The trial court took into account the applicant's statements and examined them against the testimony of the alleged instigators and of the officers of the Special Investigation Service, but also against those of the applicant's co-accused (who pleaded guilty and whom the applicant for some reason had not accused of incitement), as well as against the evidence obtained after the authorisation of the actions simulating criminal conduct (see paragraphs 27 and 29 of the judgment); it also had regard to the applicant's entrapment plea, heard witnesses, and analysed voice and video-recordings and transcripts of the conversations between the applicant and the alleged instigators (compare Lagutin and Others v. Russia, nos. 6228/09 and 4 others, § 101, 24 April 2014). - EGMR, 16.07.2015 - 43490/07
