  • EGMR, 06.04.2000 - 26772/95

    LABITA c. ITALIE

    Auszug aus EGMR, 11.12.2003 - 39084/97
It prohibits in absolute terms torture or inhuman or degrading treatment or punishment, irrespective of the circumstances and the victim's behaviour (see, for example, Labita v. Italy [GC], no 26772/95, § 119, ECHR 2000-IV).

Where such grounds were "relevant" and "sufficient", the Court must also ascertain whether the competent national authorities displayed "special diligence" in the conduct of the proceedings (see Labita v. Italy [GC], no. 26772/95, §§ 152 and 153, ECHR 2000-IV).

  • EGMR, 07.07.1989 - 14038/88

    Jens Söring

    Auszug aus EGMR, 11.12.2003 - 39084/97
It has deemed treatment to be "degrading" because it was such as to diminish the victims' human dignity or to arouse in them feelings of fear, anguish and inferiority capable of humiliating and debasing them (see, mutatis mutandis, the Tyrer v. the United Kingdom judgment of 25 April 1978, Series A no. 26, p. 15, § 30; the Soering v. the United Kingdom judgment of 7 July 1989, Series A no. 161, p. 39, § 100; see V. v. the United Kingdom [GC], no. 24888/94, § 71, ECHR 1999-IX; and Valasinas v. Lithuania, § 117, no. 44558/98, ECHR 2001-VIII).
  • EGMR, 07.12.1976 - 5493/72
    Auszug aus EGMR, 11.12.2003 - 39084/97
The Court reiterates the fundamental principles underlying its judgments relating to Article 10 (see, among other authorities, the following judgments: Handyside v. the United Kingdom, 7 December 1976, Series A no. 24; Lingens v. Austria, 8 July 1986, Series A, no. 103; Jersild v. Denmark, 23 September 1994, Series A, no. 298; Sürek v. Turkey (no.1) [GC], no. 26682/95, ECHR 1999-IV; Janowski v. Ableitung einer allgemeinen Verpflichtung zur Entlassung eines …

    Auszug aus EGMR, 11.12.2003 - 39084/97
The State must ensure that a person is detained in conditions which are compatible with respect for his human dignity, that the manner and method of the execution of the measure do not subject him to distress or hardship of an intensity exceeding the unavoidable level of suffering inherent in detention and that, given the practical demands of imprisonment, his health and well-being are adequately secured (Kudła v. Poland [GC], no. 30210/96, §§ 93-94, ECHR 2000-XI).
  • EGMR, 25.04.1978 - 5856/72
  • EGMR, 15.07.2002 - 47095/99

Russland, Haftbedingungen, EMRK, Europäische Menschenrechtskonvention, …

    Auszug aus EGMR, 11.12.2003 - 39084/97
In considering whether treatment is "degrading" within the meaning of Article 3, the Court will have regard to whether its object is to humiliate and debase the person concerned and whether, as far as the consequences are concerned, it adversely affected his or her personality in a manner incompatible with Article 3. Even the absence of such a purpose cannot conclusively rule out a finding of a violation of Article 3 (see, for example, Peers v. Greece, no. 28524/95, § 74, ECHR 2001-III; and Kalashnikov v. Russia, no. 47095/99, § 101, ECHR 2002-VI).
  • EGMR, 28.06.1984 - 7819/77
    Auszug aus EGMR, 11.12.2003 - 39084/97
In accordance with the Court's case-law, depending on several factors, including the nature of the offence and the severity of the punishment, disciplinary proceedings may in certain circumstances be considered as proceedings determining "criminal charges" within the meaning of Article 6 of the Convention (see, Ezeh and Connors v. the United Kingdom [GC], nos. 39665/98 and 40086/98, ECHR 2003- ; and the Campbell and Fell v. the United Kingdom judgment of 28 June 1984, Series A no. 80).
  • EGMR, 25.03.1999 - 25444/94
    Auszug aus EGMR, 11.12.2003 - 39084/97
Having regard to the criteria established in its case-law for the assessment of the reasonableness of the length of proceedings (see, among many others, Pélissier and Sassi v. France [GC], no. 25444/94, 25 March 1999; and Pedersen and Baadsgaard v. Denmark, no. 49017/99, 19 June 2003), the Court finds that the length of the criminal proceedings against the applicant failed to satisfy the reasonable time requirement of Article 6 § 1 of the Convention.
  • EGMR, 19.04.2001 - 28524/95

    PEERS v. GREECE

NIKULA c. FINLANDE

NANKOV v. BULGARIA

  • EGMR, 09.03.2010 - 36882/05

    [ENG]

The position of the domestic authorities went against this Court's jurisprudence (notably, T v. the United Kingdom, application no. 8231/78 (1983) 49 DR 5; the above cited cases of Bamber and Hirst; Silver and Others v. the United Kingdom, 25 March 1983, Series A no. 61; Dickson v. the United Kingdom [GC], no. 44362/04, ECHR 2007-XIII; and Yankov v. Bulgaria, no. 39084/97, ECHR 2003-XII (extracts)).

The Court recalls the fundamental principles underlying its judgments as regards Article 10 of the Convention (Yankov v. Bulgaria, no. 39084/97, § 129, ECHR 2003-XII (extracts)) and as regards the rights enjoyed by prisoners as outlined in its Hirst judgment (cited above):.

For example,... they continue to enjoy... the right to freedom of expression (Yankov v. Bulgaria, no. 39084/97, §§ 126-45, ECHR 2003-XII, and T. v. the United Kingdom, no. 8231/78, Commission's report of 12 October 1983, DR 49, p. 5, §§ 44-84);... the right to respect for correspondence (Silver and Others v. the United Kingdom, judgment of 25 March 1983, Series A no. 61);.

  • EGMR, 10.08.2006 - 55389/00

    DOBREV v. BULGARIA

The relevant provisions of the Code of Criminal Procedure (the "CCP") and the Bulgarian courts' practice at the relevant time are summarised in the Court's judgments in several similar cases (see, among others, Nikolova v. Bulgaria [GC], no. 31195/96, §§ 25-36, ECHR 1999-II; Ilijkov v. Bulgaria, no. 33977/96, §§ 55-59, 26 July 2001; and Yankov v. Bulgaria, no. 39084/97, §§ 79-88, ECHR 2003-XII (extracts)).
  • EGMR, 27.11.2012 - 17892/03

    [ENG]

It has found that whilst strip-searches may be necessary on occasion to ensure prison security or prevent disorder or crime, they must be conducted in an appropriate manner and must be justified (see Valasinas v. Lithuania, no. 44558/98, § 117, ECHR 2001-VIII; Iwanczuk v. Poland, no. 25196/94, § 59, 15 November 2001; and Yankov v. Bulgaria, no. 39084/97, § 110, ECHR 2003-XII (extracts)).

As to the assertion that the statements of Mr Hamanov would be insufficient to secure the conviction of the applicant, the Court observes that the standard imposed by Article 5 § 1 (c) does not presuppose that the facts which raise a suspicion should be of the same level as those necessary to justify a conviction (see O'Hara v. the United Kingdom, no. 37555/97, § 36, ECHR 2001-X).
