Consequently, the complaint under paragraph 2 (art. 5-2) amounts, in the particular circumstances, to no more than one aspect of the complaint that the Court has already considered in relation to paragraph 4 (art. 5-4); there is no call to rule on the merits of a particular issue which is part of and absorbed by a wider issue (see, mutatis mutandis, the above-mentioned Deweer judgment, pp. 30-31, par. 56 in fine, and the Dudgeon judgment of 22 October 1981, Series A no. 45, par. 69). - EGMR, 27.02.1980 - 6903/75
Auszug aus EGMR, 05.11.1981 - 7215/75
Although the next of kin are today to be regarded as having the status of "applicants" (see the Deweer judgment of 27 February 1980, Series A no. 35, pp. 19-20, par. 37), for the sake of convenience the present judgment will continue to refer to X as the "applicant". - EGMR, 06.11.1980 - 7367/76
Auszug aus EGMR, 05.11.1981 - 7215/75
In the Court's view, there was, in the full sense of the term, a "conviction" - that is to say, a finding of guilt (see the Guzzardi judgment of 6 November 1980, Series A no. 39, p. 37 par. 100) - "by a competent court" and, following and dependent upon that conviction, a "lawful detention" ordered by the same court. - EGMR, 24.10.1979 - 6301/73
Auszug aus EGMR, 05.11.1981 - 7215/75
1 (e) (art. 5-1-e): except in emergency cases, the individual concerned must be reliably shown to be of unsound mind, that is to say, a true mental disorder must be established before a competent authority on the basis of objective medical expertise; the mental disorder must be of a kind or degree warranting compulsory confinement; and the validity of continued confinement depends upon the persistence of such a disorder (Series A no. 33, p. 18, par. 39). - EGMR, 28.11.1978 - 6210/73

2 (art. 5-2) whose requirements, moreover, the Government continue to deny having contravened (see the above-mentioned Deweer judgment, p. 20 par. 37 in fine, and the Luedicke, Belkacem and Koç judgment of 28 November 1978, Series A no. 29, p. 15, par. 36).

November 1981, Beschwerde-Nr. 7215/75, X. ./. Vereinigtes Königreich, Rn. 39 und Rn. 46 f.;… Urteil vom 22. Oktober 2009, Beschwerde-Nr. 1431/03, Stojanovski ./. Ehemalige Jugoslawische Republik Mazedonien, Rn. 30;… Urteil vom 17. Dezember 2009, Beschwerde-Nr. 19359/04, M. ./. Deutschland, Rn. 103). - EGMR, 07.01.2016 - 23279/14
Therapieunterbringung (Sicherungsverwahrung) bei schwerer psychischer Störung …
98. In deciding whether an individual should be detained as a person 'of unsound mind", the national authorities are to be recognised as having a certain discretion, in particular on the merits of clinical diagnoses, since it is in the first place for the national authorities to evaluate the evidence adduced before them in a particular case; the Court's task is to review under the Convention the decisions of those authorities (see Winterwerp, cited above, § 40; X v. the United Kingdom, 5 November 1981, § 43, Series A no. 46; H.L. v. the United Kingdom, no. 45508/99, § 98, ECHR 2004"IX; and S. v. Germany, no. 3300/10, § 81, 28 June 2012). - EGMR, 24.06.1982 - 7906/77 The word "after" does not simply mean that the "detention" must follow the "conviction" in point of time: in addition, the "detention" must result from, "follow and depend upon" or occur "by virtue of" the "conviction" (see the X v. the United Kingdom judgment of 5 November 1981. Series A no. 46, p. 17, par. 39; the Engel and others judgment of 8 June 1976, Series A no. 22, p. 27, par.
In those circumstances, a detention that was lawful at the outset would be transformed into a deprivation of liberty that was arbitrary and, hence, incompatible with Article 5 (art. 5) (see, notably, the above-mentioned X v. the United Kingdom judgment, Series A no. 46, p. 19, par. 43).
However, as the Court has recently pointed out, this passage "speaks only of 'the decision depriving a person of his liberty'; it does not purport to deal with an ensuing period of detention in which new issues affecting the lawfulness of the detention might subsequently arise" (see the above-mentioned X v. the United Kingdom judgment, Series A no. 46, p. 22, par. 51).
The Court recalls that the scope of the obligation undertaken by the Contracting States under paragraph 4 of Article 5 (art. 5-4) "will not necessarily be the same in alle circumstances and as regards every category of deprivation of liberty" (see the above-mentioned X v. the United Kingdom judgment, Series A no. 46, p. 22, par. 52).
1 (art. 5-1) (see, mutatis mutandis, the above-mentioned X v. the United Kingdom, judgment, Series A no. 46, p. 25, par. 57, to be read in conjunction with the above-mentioned Winterwerp judgment, Series A no. 33, p. 17, par. 39, and pp. 19-20, par. 45).
Quite apart from conformity with domestic law, "no detention that is arbitrary can ever be regarded as 'lawful'" for the purposes of paragraph 1 (art. 5-1) (see, amongst others, the above-mentioned X v. the United Kingdom judgment, Series A no. 46, p. 19, par. 43).
It follows that the individual concerned must be entitled to apply to a "court" having jurisdiction to determine whether or not there has been a violation of that kind; this possibility must be open to him during the course of his detention - once a certain period has elapsed since the detention began and thereafter at reasonable intervals (see, mutatis mutandis, the above-mentioned X v. the United Kingdom judgment, Series A no. 46, pp. 22-23, par. 52) - and also at the moment of any return to detention after being at liberty.
The Board is not a "court" within the meaning of the Convention, does not afford to detainees who appear before it the guarantees of judicial procedure determine the "lawfulness" of the "detention" of the individuals concerned or, a fortiori, to "order" the release of such of them whose deprivation of liberty it may consider "unlawful" (see, notably, the above-mentioned X v. the United Kingdom judgment, Series A no. 46, p. 23, par. 53, and p. 26, par. 61, and the Ireland v. the United Kingdom judgment of 18 January 1978, Series A no. 25, p. 76, par. 200).
4 (art. 5-4), or by exercising these two remedies concurrently or successively (see, mutatis mutandis, the above-mentioned X v. the United Kingdom judgment, Series A no. 46, p. 26, par. 60).
- EGMR, 28.06.1984 - 7819/77 1 (art. 6-1) is not necessarily to be understood as signifying a court of law of the classic kind, integrated within the standard judicial machinery of the country (see, mutatis mutandis, the X v. the United Kingdom judgment of 5 November 1981, Series A no. 46, p. 23, para. 53).
November 1981, Série A Nr. 46, S. 20, Ziff. 43, EGMR-E 2, 36 und das Urteil Luberti vom 23. Februar 1984, Série A Nr. 75, S. 12, Ziff. 27, EGMR-E 2, 359).
November 1981, Série A Nr. 46, S. 7, Ziff. 10, EGMR-E 2, 29).
November 1981, Série A Nr. 46, S. 20, Ziff. 43 a.E., EGMR-E 2, 36).
Juni 1982, Série A Nr. 50, S. 26, Ziff. 49, EGMR-E 2, 91).
- EGMR, 25.03.1983 - 5947/72 Nevertheless, dating as they do from 1975 and 1981, they clearly could not have restored the right claimed by Mr. Silver under Article 6 § 1 (art. 6-1); it is therefore not possible to speak of a "solution", even partial, "of the matter" (see, mutatis mutandis, Rule 47 § 2 of the Rules of Court and the X v. the United Kingdom judgment of 5 November 1981, Series A no. 46, p. 27, § 64).
(c) although no single remedy may itself entirely satisfy the requirements of Article 13 (art. 13), the aggregate of remedies provided for under domestic law may do so (see, mutatis mutandis, the above-mentioned X v. the United Kingdom judgment, Series A no. 46, p. 26, § 60, and the Van Droogenbroeck judgment of 24 June 1982, Series A no. 50, p. 32, § 56);.

Royaume-Uni du 5 novembre 1981, série A no 46, pp. 17-18, par. 39, et B. c. Autriche du 28 mars 1990, série A no 175, pp. 14-15, paras.

32). - EGMR, 06.02.1981 - 6289/73
