France [GC], no 30979/96, § 43, CEDH 2000-VII). - EGMR, 22.05.2001 - 33592/96
France, no 33592/96, § 47, 22 mai 2001). - EGMR, 06.11.1980 - 7654/76
Italie (déc.), no 69789/01, CEDH 2001-IX). - EGMR, 06.09.2001 - 69789/01
BRUSCO v. ITALY
Auszug aus EGMR, 03.05.2007 - 26867/02

LUKENDA v. SLOVENIA

HUNGARY
However, the Court points out that the existence of mere doubts as to the prospects of success of a particular remedy which is not obviously futile is not a valid reason for failing to exhaust domestic remedies (see Akdivar and Others, cited above, § 71; Brusco v. Italy (dec.), no. 69789/01, ECHR 2001-IX; Grzinčič v. Slovenia, no. 26867/02, § 84, 3 May 2007; Hodžić, decision cited above, § 18; and Muratović v. Serbia (dec.), no. 41698/06, § 15, 21 March 2017). - EGMR, 16.10.2014 - 24141/06
PIPUS v. SLOVENIA
For relevant domestic law see Grzincic v. Slovenia, no. 26867/02, 3 May 2007.The Court recalls in this respect that it has already found in the case of Grzincic v. Slovenia (no. 26867/02, cited above), followed by the decision in Korenjak v. Slovenia ((dec.) no. 463/03, 15 May 2007), basing its conclusions on an assessment of the legislative provisions of the 2006 Act, that the aggregate of remedies provided for in cases involving excessively long proceedings pending at first and second instance was effective in the sense that the remedies were, in principle, capable of both preventing the continuation of the alleged violation of the right to a hearing without undue delay, and of providing adequate redress for any violation that has already occurred (Grzincic, cited above, § 98).
- EGMR, 16.10.2014 - 72072/12
BUBNIK v. SLOVENIA
For relevant domestic law see Grzincic v. Slovenia, no. 26867/02, 3 May 2007.The Court recalls that it has already found in the case of Grzincic v. Slovenia (no. 26867/02, cited above), followed by the decision in Korenjak v. VALADA MATOS DAS NEVES c. PORTUGAL
Italie, (dec.) no 69789/01, CEDH 2001-IX ; Nogolica c. Croatie (déc.), no 77784/01, CEDH 2002-VIII, Marien c. Belgique (déc.), no 46046/99, 24 juin 2004, Grzinčič c. Slovénie, no 26867/02, § 110, 3 mai 2007 ; Techniki Olympiaki A.E. c. Grèce (déc.), no 40547/10, 1er octobre 2013, § 58 ; Xynos c. Grèce, no 30226/09, § 54, 9 octobre 2014). - EGMR, 14.02.2012 - 37169/03
WEISS v. SLOVENIA
See domestic law in the Court's judgment Grzincic v. Slovenia (no. 26867/02, §§ 36-48, 3 May 2007).As to the judicial part of the proceedings pending before the Administrative Court on 1 January 2007 when the 2006 Act became applicable and terminated on 18 March 2008, the Court notes that the applicant failed to use any remedies available under the 2006 Act either before the first-instance court (see Grzincic v. Slovenia, no. 26867/02) or before the Supreme Court (see Nezirovic, cited above, § 28).
- EGMR, 15.05.2012 - 26742/06
CRNIC v. SLOVENIA
A description of relevant domestic law can be found in the judgment Grzincic v. Slovenia (no. 26867/02, 3 May 2007, §§ 35-48).Thus, the complaint made under Article 6 must be rejected for non-exhaustion of domestic remedies and the complaint made under Article 13 as manifestly ill-founded (see Grzincic v. Slovenia, no. 26867/02, § 110, 3 May 2007 and Korenjak v. Slovenia, no. 463/03, § 75, 15 May 2007) pursuant to Article 35 § 4 of the Convention.
- EGMR, 12.01.2010 - 30658/03
JESENICNIK v. SLOVENIA
This complaint should therefore be rejected for non-exhaustion of domestic remedies (see Grzincic v. Slovenia, no. 26867/02, 3 May 2007; Žunic v. Slovenia, no. 24342/04, 18 October 2007; and Nezirovic v. Slovenia, no. 16400/06, 18 November 2008).The Court has already found that the 2006 Act does afford the applicant an effective remedy in respect of his complaint about the length of proceedings before the first- and second-instance courts (see Grzincic v. Slovenia, no. 26867/02, 3 May 2007).
- EGMR, 07.07.2009 - 14610/02
BLEKIC v. SLOVENIA
See domestic law in the Court's judgment Grzincic v. Slovenia (no. 26867/02, 3 May 2007).As to the second set of proceedings the Court observes that they terminated after 1 January 2007, when the 2006 Act came into force, introducing new domestic remedies in the event of unduly long proceedings pending at first or second instance on 1 January 2007 (see Grzincic v. Slovenia, no. 26867/02, judgment, 3 May 2007).
- EGMR, 10.05.2011 - 48059/06
DIMITROV AND HAMANOV v. BULGARIA
The Court would further emphasise that, to be truly effective and compliant with the principle of subsidiarity, a compensatory remedy needs to operate retrospectively and provide redress in respect of delays which predate its introduction, both in proceedings which are still pending and in proceedings which have been concluded but in which the persons charged with a criminal offence have already applied to the Court or may do so (see Brusco v. Italy (dec.), no. 69789/01, ECHR 2001-IX; Nogolica v. Croatia (dec.), no. 77784/01, ECHR 2002-VIII; Charzynski v. Poland (dec.), no. 15212/03, §§ 20, 23, 36 and 40, ECHR 2005-V; Michalak v. Poland (dec.), no. 24549/03, §§ 20, 23, 37 and 41, 1 March 2005; Vokurka v. the Czech Republic (dec.), no. 40552/02, §§ 11 in fine and 62, 16 October 2007; Grzincic v. Slovenia, no. 26867/02, § 48 and 57-68, ECHR 2007-V (extracts); and Korenjak v. Slovenia (dec.), no. 463/03, § 39 and 63-71, 15 May 2007). - EGMR, 08.12.2016 - 23032/02
