Dans son arrêt Tyrer c. Royaume-Uni du 25 avril 1978 (série A no 26), la Cour a constaté qu'un châtiment corporel peut se révéler incompatible avec la dignité et l'intégrité physique de la personne, protégées par l'article 3 (art. 3).Il faut prendre en compte des facteurs tels que la nature et le contexte de la peine, ses modalités d'exécution, sa durée, ses effets physiques ou mentaux ainsi, parfois, que le sexe, l'âge et l'état de santé de la victime (arrêt Irlande c. Royaume-Uni du 18 janvier 1978, série A no 25, p. 65, par. 162, arrêt Tyrer précité, série A no 26, pp. 14-15, paras. 29-30, et arrêt Soering précité, série A no 161, p. 39, par. 100).
Une peine qui n'entraîne pas de telles séquelles peut tomber sous l'empire de l'article 3 (art. 3) (arrêt Tyrer précité, série A no 26, pp. 16-17, par. 33) si l'on peut considérer qu'en l'occurrence elle atteignait le seuil de gravité requis.
