  • EGMR, 26.03.1987 - 9248/81
    Auszug aus EGMR, 08.11.2016 - 18030/11
They requested the Court to take into account the travaux préparatoires and the case-law following the judgment in Leander v. Sweden (26 March 1987, Series A no. 116).

"The Court reiterates that the storing of data relating to the 'private life' of an individual falls within the application of Article 8 § 1 (see the Leander v. Sweden judgment of 26 March 1987, Series A no. 116, p. 22, § 48).

Article 10 does not... embody an obligation on the Government to impart such information to the individual" (see Leander v Sweden, § 74, 26 March 1987, Series A no. 116; see also below, paragraphs 19-29).

  • EGMR, 29.04.2002 - 2346/02

Vereinbarkeit der strafrechtlichen Verfolgung der Beihilfe zum Selbstmord mit der …

    Auszug aus EGMR, 08.11.2016 - 18030/11
It points out in this connection that the concept of "private life" is a broad term not susceptible to exhaustive definition (see S. and Marper v. the United Kingdom [GC], nos. 30562/04 and 30566/04, § 66, ECHR 2008, and Pretty v. the United Kingdom, no. 2346/02, § 61, ECHR 2002-III).

Even more clearly, in the Pretty v. the United Kingdom judgment (no. 2346/02, § 39, ECHR 2002-III) the Court refused to extend the wording of Article 2 of the Convention, on the right to life, in such a way as to recognise the right to die.

  • EGMR, 16.12.1992 - 13710/88
    Auszug aus EGMR, 08.11.2016 - 18030/11
Private life may also include activities of a professional or business nature (see Niemietz v. Germany, 16 December 1992, § 29, Series A no. 251-B).

In particular, respect for private life comprises the right to establish and develop relationships with other human beings; furthermore, there is no reason of principle to justify excluding activities of a professional or business nature from the notion of 'private life' (see the Niemietz v. Germany judgment of 16 December 1992, Series A no. 251-B, pp. 33-34, § 29, and the Halford judgment cited above, pp. 1015-16, § 42).".

    17. The applicable principles of interpretation applied by the Court in this context were recently summarised in Slovenia v. Croatia (dec.) [GC], no. 54155/16, § 60, 18 November 2020 (based on the judgment in Magyar Helsinki Bizottság v. Hungary [GC], no. 18030/11, §§ 118-22 and 125, 8 November 2016; with further references): "(a) As an international treaty, the Convention must be interpreted in the light of the rules of interpretation provided for in Articles 31 to 33 of the Vienna Convention on the Law of Treaties of 23 May 1969 (...).
