Andererseits geht es um die Überprüfung der "Notwendigkeit" des gerügten Eingriffs: Musste es als "in einer demokratischen Gesellschaft notwendig" angesehen werden, die Verfolgung der Ziele der an der Tarifvereinbarung von 1975 beteiligten Gewerkschaften gesetzgeberisch zu sanktionieren, so dass die Entlassung der bereits vor dem Abschluss jenes Tarifvertrags eingestellten Bf. rechtmäßig wurde? 63. In seiner Entscheidung im Fall Handyside (Urteil vom 7. Dezember 1976, Série A Nr. 24, EGMR-E 1, 217) hat der Gerichtshof eine Reihe von Grundsätzen aufgestellt, die bei der Beurteilung der "Notwendigkeit" einer bestimmten Maßnahme zu beachten sind.Erstens ist davon auszugehen, dass "notwendig" in diesem Kontext nicht die flexible Bedeutung von Begriffen wie "nützlich" oder "angebracht" hat (Urteil vom 7. Dezember 1976, a.a.O , S. 22, Ziff. 48, EGMR-E 1, 222 f.).
Zweitens sind Pluralismus, Toleranz und Aufgeschlossenheit Wesensmerkmale einer "demokratischen Gesellschaft" (Urteil vom 7. Dezember 1976, a.a.O., S. 23, Ziff. 49, EGMR-E 1, 223 f.).
Drittens hat jede Einschränkung eines sich aus der Konvention ergebenden Rechts im Verhältnis zu dem mit ihr verfolgten rechtmäßigen Ziel zu stehen (Urteil vom 7. Dezember 1976, a.a.O., S. 23, Ziff. 49, EGMR-E 1, 223 f.).

59. Ein Eingriff in die Ausübung eines der in Art. 11 geschützten Rechte kann nur dann als durch Abs. 2 dieser Bestimmung gerechtfertigt angesehen werden, wenn ein solcher Eingriff "gesetzlich vorgesehen" ist und dem oder den Zielen dient, die im Rahmen dieser Bestimmung als rechtmäßig anzusehen sind sowie "in einer demokratischen Gesellschaft notwendig" ist (vgl. u.a. Vereinbarkeit von closed-shop-Vereinbarungen mit Art. 11 Abs. 1 EMRK?
The Act on Protection against Dismissal due to Association Membership was passed by Parliament in 1982 as a result, inter alia, of the British Rail judgment (Young, James and Webster v. the United Kingdom, Series A no. 44) delivered by the Court of Human Rights in 1981."Act no. 285 of 9 June 1982 on Protection against Dismissal due to Association Membership was passed notably in order to comply with the negative right to freedom of association to the extent that such an obligation could be established according to the interpretation of Article 11 of the Convention given by the Court of Human Rights in the Young, James and Webster v. the UK judgment, Series A no. 44 (British Rail).
The Act on Protection against Dismissal due to Association Membership of 9 June 1982 (which was passed as a direct result of the Court's ruling in Young, James and Webster v. the United Kingdom, judgment of 13 August 1981, Series A no. 44), as amended by Act no. 347 of 29 May 1990, reads in so far as relevant:.
"According to the Young, James and Webster v. UK judgment of 13 August 1981, Series A no. 44 (British Rail) it is in breach of Article 11 of the European Convention on Human Rights concerning freedom of association to dismiss an employee who refuses to join a trade union with whom the employer has entered into a closed-shop agreement at a time after the employment of the employee, in so far as membership was not a condition for the employment.
The Court's case-law on this point had not altered since the case of Young, James and Webster v. the United Kingdom (judgment of 13 August 1981, Series A no. 44).
However, as was emphasised by the Court in the case of Young, James and Webster v. the United Kingdom (judgment of 13 August 1981, Series A no. 44, § 53), it is not the role of the Court to review a closed-shop system as such in relation to the Convention or to express an opinion on every consequence or form of compulsion which it may engender.
In Young, James and Webster v. the United Kingdom (judgment of 13 August 1981, Series A no. 44, § 52) the Court held that, even assuming that a general rule such as the one contained in Article 20 § 2 of the Universal Declaration could not be regarded as itself enshrined in the Convention, it did not follow that the negative aspect of a person's freedom of association fell completely outside the ambit of Article 11 and that each and every compulsion to join a particular trade union was compatible with the intention of that provision.
