    Lastly, the Court has found that the detention of an applicant, who was also an asylum seeker, for three months in an overcrowded place in appalling conditions of hygiene and cleanliness, with no leisure or catering facilities, where the dilapidated state of repair of the sanitary facilities rendered them virtually unusable and where the detainees slept in extremely filthy and crowded conditions amounted to degrading treatment prohibited by Article 3 (see A.A. v. Greece, no. 12186/08, §§ 57 to 65, 22 July 2010).

    Of course, in A.A. v. Greece, no. 12186/08, §§ 57 to 65, 22 July 2010, where these conditions were found to amount to humiliation, the period was considerably longer, namely 3 months.

    Rn. 92 Diese besonders hohe Schwelle der Erheblichkeit wäre erreicht, wenn die Gleichgültigkeit der Behörden eines Mitgliedstaats zur Folge hätte, dass eine vollständig von öffentlicher Unterstützung abhängige Person sich unabhängig von ihrem Willen und ihren persönlichen Entscheidungen in einer Situation extremer materieller Not befände, die es ihr nicht erlaubte, ihre elementarsten Bedürfnisse zu befriedigen, wie insbesondere sich zu ernähren, sich zu waschen und eine Unterkunft zu finden, und die ihre physische oder psychische Gesundheit beeinträchtigte oder sie in einen Zustand der Verelendung versetzte, der mit der Menschenwürde unvereinbar wäre (vgl. in diesem Sinne EGMR, 21. Januar 2011, M.S.S./Belgien und Griechenland, CE:ECHR:2011:0121JUD003069609, §§ 252 bis 263).

    Bei einem Sachverhalt, der denen der Ausgangsverfahren gleicht, nämlich einer Überstellung eines Asylbewerbers an Griechenland, den im Sinne der Verordnung Nr. 343/2003 zuständigen Mitgliedstaat, im Juni 2009, hat der Europäische Gerichtshof für Menschenrechte u. a. entschieden, dass das Königreich Belgien gegen Art. 3 EMRK verstoßen habe, indem es den Beschwerdeführer zum einen den sich aus den Mängeln des Asylverfahrens in Griechenland ergebenden Risiken ausgesetzt habe, da die belgischen Behörden gewusst hätten oder hätten wissen müssen, dass eine gewissenhafte Prüfung seines Asylantrags durch die griechischen Behörden in keiner Weise gewährleistet gewesen sei, und indem es ihn zum anderen wissentlich Haft- und Existenzbedingungen ausgesetzt habe, die eine erniedrigende Behandlung darstellten (Urteil des Europäischen Gerichtshofs für Menschenrechte vom 21. Januar 2011, M.S.S./Belgien und Griechenland, noch nicht im Recueil des arrêts et décisions veröffentlicht, §§ 358, 360 und 367).

    Für den Befund, dass die Risiken für den Beschwerdeführer hinreichend erwiesen seien, hat der Europäische Gerichtshof für Menschenrechte die regelmäßigen und übereinstimmenden Berichte von internationalen Nichtregierungsorganisationen, in denen auf die praktischen Schwierigkeiten bei der Anwendung des Gemeinsamen Europäischen Asylsystems in Griechenland hingewiesen wurde, die an den zuständigen belgischen Minister gesandten Schreiben des UN-Flüchtlingskommissariats, aber auch die Berichte der Kommission zur Bewertung des Dublin-Systems und die Vorschläge zur Überarbeitung der Verordnung Nr. 343/2003 zwecks der Steigerung der Wirksamkeit dieses Systems und der Stärkung des tatsächlichen Grundrechtsschutzes (Urteil M.S.S./Belgien und Griechenland, §§ 347 bis 350) berücksichtigt.

    Seit dem Ergehen der Vorlageentscheidung hat der Europäische Gerichtshof für Menschenrechte seinen Standpunkt im Licht neuer Beweise überprüft und im Urteil M.S.S./Belgien und Griechenland nicht nur entschieden, dass die Hellenische Republik wegen der Haft- und Existenzbedingungen des Beschwerdeführers in Griechenland gegen Art. 3 EMRK sowie wegen der Mängel des den Beschwerdeführer betreffenden Asylverfahrens gegen Art. 13 EMRK in Verbindung mit Art. 3 EMRK verstoßen habe, sondern auch, dass das Königreich Belgien gegen Art. 3 EMRK verstoßen habe, weil es den Beschwerdeführer Risiken im Zusammenhang mit den Mängeln des Asylverfahrens in Griechenland und Haft- und Existenzbedingungen in Griechenland, die diesem Artikel zuwiderliefen, ausgesetzt habe.

    Die Bestimmung dieses Mindestmaßes an Schwere ist relativ und hängt von allen Umständen des Falles ab, insbesondere von der Dauer der Behandlung, den daraus erwachsenen körperlichen und mentalen Folgen für den Betroffenen und in bestimmten Fällen auch vom Geschlecht, Alter und Gesundheitszustand des Betroffenen (EGMR , Urteile vom 21. Januar 2011 - Nr. 30696/09, M. S. S./Belgien und Griechenland - Rn. 219 …und vom 13. Dezember 2016 - Nr. 41738/10 - Rn. 174).

    Allerdings enthält Art. 3 EMRK weder eine Verpflichtung der Vertragsstaaten, jedermann in ihrem Hoheitsgebiet mit einer Wohnung zu versorgen, noch begründet Art. 3 EMRK eine allgemeine Verpflichtung, Flüchtlingen finanzielle Unterstützung zu gewähren oder ihnen einen bestimmten Lebensstandard zu ermöglichen (EGMR , Urteil vom 21. Januar 2011 - Nr. 30696/09 - Rn. 249).

    Der EGMR hat aber für die als besonders verletzlich gewertete Gruppe der Asylsuchenden eine aus der Aufnahmerichtlinie (aktuell: RL 2013/33/EU) folgende gesteigerte Verantwortlichkeit der EU-Mitgliedstaaten gesehen (EGMR , Urteil vom 21. Januar 2011 - Nr. 30696/09 - Rn. 250 ff.), die mit Blick auf die Richtlinie 2011/95/EU auch für international Schutzberechtigte anzunehmen ist.
