  • EGMR, 10.06.2014 - 13054/12

    BUJOREAN c. ROUMANIE

Roumanie, no 62353/09, § 27, 11 juin 2013 et Bulea c. Roumanie, no 27804/10, § 42, 3 décembre 2013).
  • EGMR, 15.06.2010 - 35555/03

    [FRE]

Roumanie, no 6586/03, § 49, 7 avril 2009).
  • EGMR, 03.10.2017 - 16986/12

    ALEXANDRU ENACHE c. ROUMANIE

Roumanie, no 62353/09, § 27, 11 juin 2013 ; Bulea c. Roumanie, no 27804/10, §§ 41-42, 3 décembre 2013 ; et Bujorean c. Roumanie, no 13054/12, § 21, 10 juin 2014).
  • EGMR, 17.07.2012 - 1831/02

    IORGOIU c. ROUMANIE

Roumanie, no 6586/03, § 42, 7 avril 2009 et Mariana Marinescu c. Roumanie, no 36110/03, § 58, 2 février 2010).
  • EGMR, 01.06.2010 - 25867/03

    [FRE]

Roumanie (no 6586/03, § 40, 7 avril 2009).
  • EGMR, 27.05.2010 - 24708/03

    [FRE]

  • EGMR, 16.06.2015 - 53168/12

    GHIROGA c. ROUMANIE

Roumanie, no 62353/09, § 27, 11 juin 2013, Bulea c. Roumanie, no 27804/10, § 42, 3 décembre 2013, et Bujorean c. Roumanie, no 13054/12, § 21, 10 juin 2014).
  • EGMR, 11.12.2012 - 60732/09

    [ENG]

Roumanie, no 4792/03, § 37, 29 avril 2008 ; Brânduse c. Roumanie, no 6586/03, §§ 37-40, 7 avril 2009 et Eugen Gabriel Radu c. Roumanie, no 3036/04, § 24, 13 octobre 2009).
  • EGMR, 26.10.2010 - 43079/02

    [ENG]

Roumanie, no 3036/04, § 23, 13 octobre 2009).
  • EGMR, 22.03.2016 - 42720/10

GOMOI v. ROMANIA and 3 other applications

Roumanie, no 62353/09, § 27, 11 juin 2013 et Bulea c. BRAGADIREANU v. ROMANIA

    Auszug aus EGMR, 04.10.2011 - 31725/04
The relevant findings and recommendations of the European Committee for the Prevention of Torture and Inhuman or Degrading Treatment or Punishment ("the CPT") are described in the Court's judgments in the cases of Bragadireanu v. Romania (no. 22088/04, §§ 7376, 6 December 2007) and Artimenco v. Romania (no. 12535/04, §§ 22-23, 30 June 2009).

Even though there are no CPT reports concerning this specific establishment, the Court has recently analysed the material conditions of detention in this prison for periods of time which overlap with the period in which the applicant was detained there (see Iamandi v. Romania, no. 25867/03, §§ 56-62, 1 June 2010 and Bragadireanu v. Romania, no. 22088/04, §§ 92-98, 6 December 2007).

    [FRE]

    Auszug aus EGMR, 04.10.2011 - 31725/04
In this connection, it observes that in recent applications against Romania concerning similar complaints it has already found that, given the specific nature of this type of complaint, the legal actions indicated by the Government, including the civil action in damages, did not constitute effective remedies (see Petrea, cited above, § 37; Eugen Gabriel Radu v. Romania, no. 3036/04, § 23, 13 October 2009; Iamandi v. Romania, no. 25867/03, § 49, 1 June 2010; Cucolas v. Romania, no. 17044/03, § 67, 26 October 2010; Ogica v. Romania, no. 24708/03, § 35, 27 May 2010; and Dimakos v. Romania, no. 10675/03, § 38, 6 July 2010).

Ableitung einer allgemeinen Verpflichtung zur Entlassung eines …

    Auszug aus EGMR, 04.10.2011 - 31725/04
Under Article 3, the State must ensure that a person is detained in conditions which are compatible with respect for his human dignity, that the manner and method of the execution of the measure do not subject him to distress or hardship of an intensity exceeding the unavoidable level of suffering inherent in detention and that, given the practical demands of imprisonment, his health and well-being are adequately secured (see Valasinas v. Lithuania, no. 44558/98, § 102, ECHR 2001-VIII, and Kudla v. Poland [GC], no. 30210/96, § 94, ECHR 2000-XI).

Russland, Haftbedingungen, EMRK, Europäische Menschenrechtskonvention, …

    Auszug aus EGMR, 04.10.2011 - 31725/04
The Court has frequently found a violation of Article 3 of the Convention on account of the lack of personal space afforded to detainees and unsatisfactory sanitary conditions (see, in particular, Ciorap v. Moldova, no. 12066/02, § 70, 19 June 2007; Kalashnikov v. Russia, no. 47095/99, §§ 97 et seq., ECHR 2002-VI; and Iamandi and Bragadireanu, cited above).

    PEERS v. GREECE

    Auszug aus EGMR, 04.10.2011 - 31725/04
Thus, even in cases where a larger prison cell was at issue - measuring in the range of three to four square metres per inmate - the Court has found a violation of Article 3 because the space factor was coupled with an established lack of ventilation and lighting (see, for example, Babushkin v. Russia, no. 67253/01, § 44, 18 October 2007; Ostrovar v. Moldova, no. 35207/03, § 89, 13 September 2005; and Peers v. Greece, no. 28524/95, §§ 70-72, ECHR 2001-III) or lack of basic privacy in a prisoner's everyday life (see, mutatis mutandis, Belevitskiy v. Russia, no. 72967/01, §§ 73-79, 1 March 2007; Valasinas, cited above, § 104; Khudoyorov v. Russia, no. 6847/02, §§ 106 and 107, ECHR 2005-X; and Novoselov v. Auszug aus EGMR, 04.10.2011 - 31725/04
In previous cases where applicants had at their disposal less than three square metres of personal space, the Court has found that the overcrowding was so severe as to justify of itself a finding of a violation of Article 3 of the Convention (see, among many other authorities, Lind v. Russia, no. 25664/05, § 59, 6 December 2007; Kantyrev v. Russia, no. 37213/02, § 50-51, 21 June 2007; Andrey Frolov v. Russia, no. 205/02, §§ 47-49, 29 March 2007; and Labzov v. Roumanie, no 56664/08, § 92, 12 avril 2011, Badila c. Roumanie, no 31725/04, § 76, 4 octobre 2011 et Fane Ciobanu c. Roumanie, no 27240/03, §§ 72-73, 11 octobre 2011).

An outline of the Court's case-law under Article 3 of the Convention in connection with conditions of detention can be found in a number of judgments concerning Romania (see, in particular, Maciuca v. Romania, no. 25763/03, 26 May 2009; Ali v. Romania, no. 20307/02, 9 November 2010; Goh v. Romania, no. 9643/03, 21 June 2011; and Badila v. Romania, no. 31725/04, 4 October 2011).
  • EGMR, 17.06.2014 - 48372/09

    MARIAN TOMA c. ROUMANIE

Roumanie, no 19730/10, § 70, 30 juillet 2013, Banu c. Roumanie, no 60732/09, §§ 36-37, 11 décembre 2012, Györgypál c. Roumanie, no 29540/08, § 73, 26 mars 2013, Scarlat c. Roumanie, nos 68492/10 et 68786/11, § 57, 23 juillet 2013, Flamînzeanu c. Roumanie, no 56664/08, § 92, 12 avril 2011, Badila c. Roumanie, no 31725/04, § 76, 4 octobre 2011, et Fane Ciobanu c. Roumanie, no 27240/03, §§ 72-73, 11 octobre 2011).
  • EGMR, 07.04.2015 - 26089/13

    ADRIAN RADU c. ROUMANIE

Roumanie, no 31725/04, § 76, 4 octobre 2011, Ţicu c. Roumanie, no 24575/10, § 62, 1er octobre 2013, et Marian Toma c. Roumanie, no 48372/09, § 33, 17 juin 2014).
  • EGMR, 30.06.2015 - 35049/08

    SERCE v. ROMANIA

Moreover, the Court has already held in a number of cases that the detention conditions in Rahova or Giurgiu Prisons, which included the presence of parasites, breached the safeguards of Article 3 of the Convention (see Iacov Stanciu, cited above; Geanopol v. Romania, no. 1777/06, 5 March 2013; and Niculescu v. Romania, no. 25333/03, 25 June 2013, for the conditions in Rahova Prison; Cucu v. Romania, no. 22362/06, 13 November 2012, and Badila v. Romania, no. 31725/04, 4 October 2011, for the conditions in Giurgiu Prison).
