  • EGMR, 28.07.1999 - 25803/94

The Court reiterates that the purpose of the exhaustion rule is to afford the Contracting States the opportunity of preventing or putting right the violations alleged against them before those allegations are submitted to it (see, among many other authorities, Selmouni v. France [GC], no. 25803/94, § 74, ECHR 1999-IV).
  • EGMR, 11.06.2002 - 36042/97

    WILLIS v. THE UNITED KINGDOM

    Auszug aus EGMR, 04.03.2008 - 42722/02
The Court's case-law on Article 14 establishes that discrimination means treating differently, without an objective and reasonable justification, persons in relevantly similar situations (Willis v. the United Kingdom, no. 36042/97, § 48, ECHR 2002-IV).
  • EGMR, 25.11.1999 - 23118/93

    NILSEN AND JOHNSEN v. NORWAY

    Auszug aus EGMR, 04.03.2008 - 42722/02
The Court reiterates that in order for costs and expenses to be reimbursed under Article 41, it must be established that they were actually and necessarily incurred and were reasonable as to quantum (see, for example, Nilsen and Johnsen v. Norway [GC], no. 23118/93, § 62, ECHR 1999-VIII, and Boicenco v. Moldova, no. 41088/05, § 176, 11 July 2006).
  • EGMR, 22.05.2001 - 33592/96
    Auszug aus EGMR, 04.03.2008 - 42722/02
However this rule is subject to exceptions which might be justified by the specific circumstances of each case (see Baumann v. France, no 33592/96, 22 May 2001, § 47, unreported, Brusco, cited above).
  • EGMR, 04.05.2001 - 28883/95
    Auszug aus EGMR, 04.03.2008 - 42722/02
The Court is sensitive to the subsidiary nature of its role and recognises that it must be cautious in taking on the role of a first-instance tribunal of fact, where this is not rendered unavoidable by the circumstances of a particular case (see, for example, McKerr v. the United Kingdom (dec.), no. 28883/95, 4 April 2000).
  • EGMR, 27.04.1988 - 9659/82
    Auszug aus EGMR, 04.03.2008 - 42722/02
In view of the Court's findings with regard to Article 3 above, this complaint is clearly "arguable" for the purposes of Article 13 (see Boyle and Rice v. the United Kingdom, judgment of 27 April 1988, Series A no. 131, § 52).
  • EGMR, 06.11.1980 - 7654/76
    Auszug aus EGMR, 04.03.2008 - 42722/02
Relying on the case Van Oosterwijck v. Belgium (judgment of 6 November 1980, Series A no. 40, pp. 18-19, § 37), they pointed out that the applicant's negative opinion of the prospects of success alone could not of itself justify or excuse failure to exercise a remedy.
  • EGMR, 01.03.2005 - 15212/03

    CHARZYNSKI c. POLOGNE

    Auszug aus EGMR, 04.03.2008 - 42722/02
The Court has accepted that this was the case when at the national level a new law, specifically designed to provide direct redress to violations of fundamental procedural rights, was introduced with retroactive effect and put thus an end to a structural problem that existed in the national legal system before its adoption (see Içyer v. Turkey (dec.), no. 18888/02, §§ 83-84, ECHR 2006-I; Charzynski v. Poland (dec.), no. 15212/03, §§ 40-41, ECHR 2005-V; and mutatis mutandis Ismayilov v. Azerbaijan, no. 4439/04, § 38, 17 January 2008).
  • EGMR, 06.09.2001 - 69789/01

    BRUSCO v. ITALY

    Auszug aus EGMR, 04.03.2008 - 42722/02
Citing Brusco v. Italy ((dec.), no. 69789/01, ECHR 2001-IX) and Nogolica v. Croatia ((dec.), no. 77784/01, ECHR 2002-VIII), they considered that the applicant had to exhaust this remedy, although it had been available only after the present application had been lodged with the Court.
  • EGMR, 12.01.2006 - 18888/02

    IÇYER c. TURQUIE

BURSUC c. ROUMANIE

  • EGMR, 12.05.2015 - 73235/12

    IDENTOBA AND OTHERS v. GEORGIA

Consideration has been given to the opening of investigations, delays in taking statements and to the length of time taken for the initial investigation (see, for instance, Stoica v. Romania, no. 42722/02, § 67, 4 March 2008).
  • EGMR, 22.02.2011 - 24329/02

    SOARE ET AUTRES c. ROUMANIE

Bulgarie, no 63106/00, § 69, 10 juin 2010; et, a contrario, Natchova, précité, § 153, Osman c. Bulgarie, no 43233/98, §§ 85 et 86, 16 février 2006; Stoica c. Roumanie, no 42722/02, § 128, 4 mars 2008; et Turan Cakir c. Belgique, no 44256/06, § 80, 10 mars 2009).

    Voir, parmi d'autres, Stoica c. Roumanie, no 42722/02, §§ 80, 81 et 132, 4 mars 2008 ; Gergely c. Roumanie, no 57885/00, §§ 16 et 25, CEDH 2007-V ; Cobzaru, précité, § 101 ; et Moldovan et autres c. Roumanie (no 2), nos 41138/98 et 64320/01, § 140, CEDH 2005-VII.

  • EGMR, 03.07.2014 - 37966/07

    ANTAYEV AND OTHERS v. RUSSIA

In such circumstances, the Court considers that the burden of proof lies on the Government (see Stoica v. Romania, no. 42722/02, § 131, 4 March 2008; Sampanis and Others v. Greece, no. 32526/05, §§ 70-71, 5 June 2008; and Makhashevy, cited above, §§ 178-79).

  • EGMR, 17.02.2015 - 70555/10

    BALASOIU c. ROUMANIE

Turquie [GC], no 21986/93, § 97, CEDH 2000-VII et Carabulea c. Roumanie, no 45661/99, § 107, 13 juillet 2010).

Roumanie (no 1), no 49234/99, § 55, 26 avril 2007).

Roumanie, no 4390/03, § 45, 5 octobre 2010 et Rupa c. Roumanie (no 2), no 37971/02, § 58, 19 juillet 2011).

  • EGMR, 14.04.2009 - 71090/01

    OLTEANU c. ROUMANIE

Roumanie, no 42066/98, §§ 68-70, 12 octobre 2004.

Roumanie, no 48254/99, §§ 60 et 64-65, 26 juillet 2007, Bursuc c. Roumanie, no 42066/98, §§ 80 et 101, 12 octobre 2004, ainsi que les références qui y figurent).

  • EGMR, 24.03.2015 - 47615/11

    VERES c. ROUMANIE

Roumanie (no 45661/99, § 82, 13 juillet 2010).

France [GC], no 25803/94, § 87, CEDH 1999-V, et Bursuc c. Roumanie, no 42066/98, § 80, 12 octobre 2004).

  • EGMR, 25.09.2012 - 18817/04

    [FRE]

Turquie [GC], no 26307/95, § 216, CEDH 2004-III ; Rupa c. Roumanie (no 1), no 58478/00, § 96, 16 décembre 2008 ; et Dumitru Popescu c. Roumanie (no 1), no 49234/99, § 61, 26 avril 2007).

Grèce [GC], no 50385/99, § 53, CEDH 2004-XI, et Rupa c. Roumanie (no 2), no 37971/02, § 23, 19 juillet 2011).

  • EGMR, 16.10.2014 - 18339/04

It not only ensures that the person is fit to be questioned in police custody but also enables a respondent Government to discharge the burden of providing a plausible explanation for any injuries found (see Carabulea v. Romania, no. 45661/99, § 112, 13 July 2010).

    ISAYEV AND OTHERS v. RUSSIA

Where a person is injured while in detention or otherwise under the control of the police, any such injury will give rise to a strong presumption that the person was subjected to ill-treatment (see, among many other authorities, Bursuc v. Romania, no. 42066/98, § 80, 12 October 2004).
  • EGMR, 20.04.2010 - 21143/02

    BALASA c. ROUMANIE

Roumanie (déc.), no 58478/00, 14 décembre 2004 ; Kalanyos et autres c. Roumanie (déc.), no 57884/00, 19 mai 2005 ; et Dumitru Popescu c. Roumanie (no 1), no 49234/99, §§ 52-53, 26 avril 2007).
