Fixierung in psychiatrischer Unterbringung: Richtervorbehalt erforderlich?
EGMR , Labita v. Italy, Urteil vom 6. April 2000, Nr. 26772/95, § 120; EGMR , Kudła v. Poland, Urteil vom 26. Oktober 2000, Nr. 30210/96, § 92; EGMR, Keenan v. The United Kingdom, Urteil vom 3. April 2001, Nr. 27229/95, § 110; EGMR, Price v. The United Kingdom, Urteil vom 10. Juli 2001, Nr. 33394/96, § 24; EGMR, Mouisel v. France, Urteil vom 14. November 2002, Nr. 67263/01, § 37). - EGMR, 12.07.2007 - 20877/04
TESTA v. CROATIA
In exceptional cases, where the state of a detainee's health is absolutely incompatible with the detention, Article 3 may require the release of such person under certain conditions (see Papon v. France (no. 1) (dec.), no. 64666/01, CEDH 2001-VI, and Priebke v. Italy (dec.), no. 48799/99, 5 April 2001) There are three particular elements to be considered in relation to the compatibility of the applicant's health with her stay in detention: (a) the medical condition of the prisoner, (b) the adequacy of the medical assistance and care provided in detention and (c) the advisability of maintaining the detention measure in view of the state of health of the applicant (see Mouisel v. France, no. 67263/01, §§ 40-42, ECHR 2002-IX). - EGMR, 22.12.2008 - 46468/06
ALEKSANYAN v. RUSSIA
Thus, in Mouisel v. France, no. 67263/01, §§ 40-42, ECHR 2002-IX) the Court examined such elements of the case as (a) the medical condition of the prisoner, (b) the adequacy of the medical assistance and care provided in detention and (c) the advisability of maintaining the detention measure in view of the state of health of the applicant.Furthermore, in view of the applicant's state of health and his previous conduct, the Court considers that the security risks he might have presented at that time, if any, were negligible compared to the health risks he faced (see Mouisel v. France, no. 67263/01, §§ 47, ECHR 2002-IX).
- EGMR, 06.10.2015 - 80442/12
Finnland, 16. Dezember 1997, Rdnr. 56, ECHR 1997-VIII; Mouisel./. Frankreich, Individualbeschwerde Nr. 67263/01, Rdnr. 47, ECHR 2002-IX; und Kashavelov./. Bulgarien, Individualbeschwerde Nr. 891/05, Rdnr. 38, 20. - EGMR, 17.12.2009 - 32704/04
DENIS VASILYEV v. RUSSIA
The Court reiterates its constant approach that Article 3 imposes on the State a duty to protect the physical well-being of persons who find themselves in a vulnerable position by virtue of being within the control of the authorities, such as, for instance, detainees or conscripted servicemen (see Chember v. Russia, no. 7188/03, § 50, 3 July 2008; Sarban v. Moldova, no. 3456/05, § 77, 4 October 2005; Jalloh v. Germany [GC], no. 54810/00, § 69, ECHR 2006-IX, and Mouisel v. France, no. 67263/01, § 40, ECHR 2002-IX). - EGMR, 10.01.2012 - 48977/09
[ENG]
In accordance with the Court's settled case-law, ill-treatment must attain a minimum level of severity if it is to fall within the scope of Article 3. The assessment of this minimum is relative; it depends on all the circumstances of the case, such as the duration of the treatment, its physical and mental effects and, in some cases, the sex, age and state of health of the victim (see, among other authorities, Price v. the United Kingdom, no. 33394/96, § 24, ECHR 2001-VII; Mouisel v. France, no. 67263/01, § 37, ECHR 2002-IX; and Naumenko v. Ukraine, no. 42023/98, § 108, 10 February 2004).Thus, in Mouisel v. France (no. 67263/01, §§ 40-42, ECHR 2002-IX) the Court examined such elements of the case as (a) the medical condition of the prisoner, (b) the adequacy of the medical assistance and care provided in detention and (c) the advisability of maintaining the detention measure in view of the state of health of the applicant.
- EGMR, 24.07.2008 - 41461/02
VLADIMIR ROMANOV v. RUSSIA
In the context of detainees, the Court has emphasised that persons in custody are in a vulnerable position and that the authorities are under a duty to protect their physical well-being (see Tarariyeva v. Russia, no. 4353/03, § 73, ECHR 2006-... (extracts); Sarban v. Moldova, no. 3456/05, § 77, 4 October 2005; and Mouisel v. France, no. 67263/01, § 40, ECHR 2002-IX). - EGMR, 29.04.2008 - 4792/03
PETREA v. ROMANIA
The Court refers to the principles established in its case-law regarding the conditions of detention and the medical care of detainees (see, for instance, Kudla v. Poland [GC], no. 30210/96, § 94, ECHR 2000-XI; Mouisel v. France, no. 67263/01, § 40, ECHR 2002-IX and Sarban v. Moldova, no. 3456/05, §§ 75-77, 4 October 2005). - EGMR, 19.06.2012 - 36937/06
[ENG]
According to the Court's settled case-law, ill-treatment must attain a minimum level of severity if it is to fall within the scope of Article 3. The assessment of this minimum level of severity is relative; it depends on all the circumstances of the case, such as the duration of the treatment, its physical and mental effects and, in some cases, the sex, age and state of health of the victim (see, among other authorities, Gäfgen v. Germany [GC], no. 22978/05, § 88, ECHR 2010; Price v. the United Kingdom, no..33394/96, § 24, ECHR 2001-VII; Mouisel v. France, no. 67263/01, § 37, ECHR 2002-IX; and Jalloh v. Germany [GC], no. 54810/00, § 67, 11 July 2006). - EGMR, 20.01.2009 - 70337/01
GÜVEÇ c. TURQUIE
At this juncture the Court reiterates that, although Article 3 of the Convention cannot be construed as laying down a general obligation to release detainees on health grounds, it nonetheless imposes an obligation on the State to protect the physical well-being of persons deprived of their liberty, for example by providing them with the requisite medical assistance (see Mouisel v. France, no. 67263/01, § 40, ECHR 2002-IX and the cases cited therein). - EGMR, 29.04.2003 - 50390/99

France, no 67263/01, § 40, CEDH 2002-IX ; Kudla c. Pologne [GC], no 30210/96, § 94, CEDH 2000-XI; Tekin Yıldız c. Turquie, no 22913/04, § 71, 10 novembre 2005).[1] McGlinchey et autres c. le Royaume-Uni, no 50390/99, 29 avril 2003, CEDH 2003-V, § 46, et Mouisel c. France, no 67263/01, CEDH 2002-IX, § 40.
[7] McGlinchey et autres c. le Royaume-Uni, no 50390/99, 29 avril 2003, CEDH 2003-V, § 46, et Mouisel c. France, no 67263/01, CEDH 2002-IX, § 40.
- EGMR, 16.07.2013 - 5002/05
[FRE]
France, no 65436/01, § 53, CEDH 2003-XI).
- EGMR, 11.07.2006 - 33834/03
RIVIERE c. FRANCE
France, no 67263/01, § 40, CEDH 2002-IX). - EGMR, 30.06.2009 - 75109/01
VIOREL BURZO c. ROUMANIE
Pologne [GC], no 30210/96, § 91, CEDH 2000-XI, Paladi c. Moldova [GC], no 39806/05, § 71, 10 mars 2009, Mouisel c. France, no 67263/01, § 38, CEDH 2002-IX). - EGMR, 19.02.2015 - 10401/12
HELHAL c. FRANCE
France, no 65436/01, §§ 54 à 58, CEDH 2003-XI). - EGMR, 13.11.2014 - 40014/10
[FRE]
- EGMR, 15.05.2008 - 7178/03
DEDOVSKIY AND OTHERS v. RUSSIA
Russie, no 4353/03, § 73, CEDH 2006-... ; Sarban c. Moldova, no 3456/05, § 77, 4 octobre 2005 ; et Mouisel c. France, no 67263/01, § 40, CEDH 2002-IX). - EGMR, 17.07.2012 - 1831/02
IORGOIU c. ROUMANIE
Pologne [GC], no 30210/96, § 91, CEDH 2000-XI, Paladi c. Moldova [GC], no 39806/05, § 71, 10 mars 2009 et Mouisel c. France, no 67263/01, § 38, CEDH 2002-IX). - EGMR, 24.05.2007 - 52058/99
